HOUSTON COUNTY - ASHFORD: Today the Honorable Brad Mendheim, 20th Judicial Circuit Court Judge heard testimony concerning the election of Whitehurst and Bolden as Ashford Councilman.
Whitehurst is reported not not live in the district in which he was elected. Bolden challenged the election, which were 10 votes apart.
Whitehurst claimed his departure from the residence he lived was "temporary" due to a fire. However the residence Whitehurst claimed he lived burned four years ago and the property did not belong to Whitehurst.
Whitehurst was represented by Attorney Tracy Cary when the case first started. When Whitehurst was sworn in as Councilman he refused to turn and say the Pledge of Allegiance to the American Flag. Immediately therafter Tracy Cary withdrew as Whitehurst attorney.
No reason was cited in the withdrawel but those who know Tracy Carey know the withdrawel was probably Whitehurst patriotic actions. Do not know factual but I have known Tracy since he practed law and that s not something he will tolerate.
So Whitehurst acted as his own attorney and Bolden was represented by Steve McGowen.
In the testimony today Whitehurst asked Bolden about a prior federal felony conviction. However Bolden is listed as an eligible registered voter.
Judge Mendheim has ordered briefs on the matter and they are due in two weeks.
