Directed VErdict of NOT GUILTY In Henry County

HENRY COUNTY:     Moments ago 20th Judicial Circuit Court Judge Butch Binford issued a directed verdict of NOT GUILTY in the case of Nicholas Cheek.


Cheek, a former Henry County Sheriff Deputy, was arrested on May 30, 2012 by the Alabama Bureau of Investigation ( now State Bureau of Investigation ) for the offense of Intimindating a Witness. 


The charges alleged that Cheek did on or about May 19, 2010 attempted by use of a threat against Ronald Wayne Bircher, a witness or a person he believed would be called as a witness in an official proceeding, to do bodily harm id the person followed through with a police report of Unauthorized Use of a Vehicle.


The allegations of Bircher towards Cheek involve the use of a tractor that Cheek was alleged to have used to pull a vehicle that was stuck.


This incident occurred during the time of the Sheriff election of 2010. Bircher was running around Abbeville and Henry County attempting to start a lot of muck about things to apparently cause harm to the re-election of the Sheriff and his dislike for Deputy Nick Cheek.


Cheek was represented by Attorney Dustin Fowler in this case.


Cheek was only tried for Intimidating A Witness, Bircher, in this trial. Cheek still has pending three felony cases, Theft of Propoerty in the second degree In Henry County Circuit Court. 


The felony Theft of Property cases stem from a May 30, 2012 arrest. Cheek was indicted June 18, 2013 and the cases were also investigated by the Alabama Bureau of Investigation ( now State Bureau of Investigation ).


One case is on March 14, 2012 Cheek is alleged to have taken control over Loritab and Roxi. One case is that on March 14, 2012 Cheek took possession of a .357 revolver. One case that Cheek took possession of another shotgun.


Each of these cases have been continued and trial will be at a later date.


Following Cheek's arrest he left Henry County and moved. He has made a succcessful life for himself.


He was a dedicated law enforcement officer for the people of Henry County. But as life develops, sometimes when folks are out to get you, they do it.


A directed verdict means, the prosecution did not prove a case sufficient to make it to a jury. Therefore the Judge in the case dismisses the case because a prima facia case was not made.
