Local developer caught in jurisdictional battle has path forward
Developer Mark Dennis has received preliminary approval to construct Phase 1 of Magnolia Lakes subdivision, which will be 71 single-family homes on Bethlehem Road near the intersection with Murphy Mill road to the east and JB Chapman Road to the west. As part of its approval, the Dothan Planning Commission approved a requirement for Dennis to construct a turn lane along Bethlehem Road’s intersection with Murphy Mill. However, Bethlehem Road is maintained by Houston County and the Planning Commission has no authority over a county-maintained road. County Commission Chairman Mark Culver has said the county does not believe the developer should build the turn lane.
Dennis came back to the Planning Commission Wednesday seeking answers.
“We find ourselves in the middle between the city we love wanting us to do one thing and the county we love wanting us to do another,” Dennis said.
Wednesday, the Planning Commission voted to retain the turn lane requirement as a condition for approval, but provided Dennis with a way out.
If Dennis applies for a construction permit from Houston County to build the turn lane and the application is denied, Dennis can move forward with Phase 1.
