4:43 Saturday, August 6. 

The court has received a question from the jury.  Judge Thompson is going to read the question.  They are handing out the question to the attorneys. 

Define unlawful plan on page 14 in first, second, and third line.  We also have a complication here that it is 10 of 5 and the jury has said they want to recess at 5.  We can either do it now and answer it in the morning, we can do it now and answer it now. 

Espy is asking to let the jury go home and let them study the question overnight.  They are not sure if the question is from the judge’s indictment or in his orders. 

Page 14 of the indictment does not include unlawful plan.  Judge Thompson thinks it is in the conspiracy in the charge.

James says they would like to have the evening to look at it.  

Parkman is asking Judge what he found and Judge Thompson says he would rather not reveal his hand until he hears from the attorneys. 

Junkins says he would move to let the jury go for the night and give them the answer tomorrow when they return at 1. 

Government has no problem with this.

The jury is returning.  Judge Thompson says this does mean they are still on count 1, the conspiracy count.  

Juror number 3 is the foreperson.  

It is going to take up a bit to get you a definition.  One tomorrow is going to be fine.  

The jury is excused for the night.  We will see them at 1:00 tomorrow to give them the definition. 

The attorneys are going to get their arguments to the Judge by 9 in the morning.
