A Con By Prosecutors

COVINGTON and HENRY COUNTY:    This article is written concerning the court hearing held in Covington County this morning. 


Since 1977, I witnessed the most dishonest presentation ever witnessed in a court of law presented by prosecutors.  On behalf of the people of the Twnetieth Judicial Circuit, I wish to apologize and hold those responsible accountable.


First, In Covington County, I am puzzled that Mr. Sam Clenny, who works for Doug Valeska, was representing Covington County before the court. Representing the defendant was Mr. James W. ( Jim ) Parkman.


I respect Mr. Clenny, however, he should take lessons on the proper way to handle major screw ups in cases from Mr. Kirke Adams, District Attorney in Dale and Geneva County.


And let me say, Sam can not make decisions without asking Doug. Sometimes that includes going to the bathroom!


ISSUE


Deputies from Henry County Sheriff Department and Abbeville Police combined task force went to a class on sexual predators. They returned to Abbeville and put together a sting on what they learned in class.


They created a ad on line. And they started trying to find them someone they could entice into a predator.


The lead investigator was Aaron Kincaid.


A conversation was held by the officers and the defendant was talked into sending a nude photograph. The officers attempted to get Driver to travel from Covington County to Henry County to meet the girl. Driver did not.


After several attempts of attempting to get the defendant to Henry County, the officers traveled to Covington County. They again contacted the defendant attempting to get him to travel to the theater to meet the girl ( officers pretending to be the girl ). The Defendant did not.


He went to church. When he returned home officers/deputies with Henry County Sheriff Department/Abbeville Police and Covington County Sheriff Department surrounded Driver and his house. They took him into custody, search his house, person vehicle, took his cell phone, computer and other evidence. The officers took Driver into custody and transported him to Abbeville.


After questioning him, the Henry County Sheriff Department/Abbeville Police Task Force placed Driver in the Henry County Jail for Transmitting Obscene Pictures to a Minor and Electronic Solicitation of a Minor.


After the defendant made bond in Henry County, Covington County Sheriff Department arrested him for the same offenses and placed him under extremely high bonds.


THEN THE COURT BEGINS


As I was reviewing the court documents to prepare for this article, I became furious and outraged. And because we this is written on my iPad, it will be tomorrow before I can download the documents and get them where you can read them.


But this will cause you to lose total faith and trust in those representing the system.


And Sam Clenny, you know better than this and you should have stood up and been a man.


The defendant was arrested on May 14, 2014. On May 28, 2014 his attorney, Jim Parkman filed a Motion To Dismiss on double jeopardy, in that he was charged with the same crimes in both Henry and Covington County. The Honorable Derek Peterson set the case for a hearing. For some reason the District Attorney failed to get notice.


The District Attorney said it was different offenses. Parkman alleged they were of the same conversation. Judge Peterson denied to the motion to dismiss.


Another motion to dismiss was filed by Parkman on June 18, 2014. On July 8, 2014 Judge Peterson denied the Motion To Dismiss. The case then went to Grand Jury.


On August 27, 2014 Driver was indicted by a Henry County Grand Jury. ( In Alabama, ham sandwiches can get indicted - because the prosecutor runs the Grand Jury ).


On December 3, 2014 Attorney Jim Parkman filed motions for "Spacific Discovery". That was because Officer Aaron Kincaid testified " I had multiple certifications for investigations including certifications for investigating sexual predators on the Internet".


The motion also pointed out the discovery information provided to the defense did not contain every one half of the some 349 text messages the officer testified he had. The information was not complete and a lot of messages were not provided.


Also the Henry County Sheriff Department/Abbeville Police and Covington County Sheriff Department executed search warrants on the defendants residence, car, person, computers, cell phone, and the names of the persons so examining and results had not been provided.


Judge Peterson entered an order on December 4, 2014 the Motion for Specific Discovery is hereby noted. The State ( District Attorney ) has 30 days to respond to the motion.


On March 5, 2015 Attorney Jim Parkman filed another motion to dismiss in that material ordered to be turned over had not been provided.


Dialougue and court actions continue. On November 10, 2015 Parkman again notifies the court that text messages are missing.


And it is like the court is begging the District Attorney, do your job, provide the material.


The case later gets transferred to Circuit Judge Mike Conaway. He enters orders for the District Attorney to provide the material.


Conaway, when the case is hitting the end of the line, first denies the Motion To Dismiss. In my opinion, Judge COnaway did not grasp the magnitude of what was really happening.


FOLKS - Henry County Sheriff Department/Abbeville Police Department LOST, they do not know where the cell phone or computers they took from Driver's house are at. They do not know where the missing text messages are at.


Former Officer Kincaid left Henry County and moved to Texas.


Parkman files another motion with Judge Conaway. He finally grasps the real truth and Conaway dismisses the case in Henry County.


COVINGTON COUNTY


Today the hearing to dismiss the cases in Covington County. I listen to Parkman and Sam Clenny. Still can not figure out why Sam Clenny is the Covington County prosector on the case. And I listen to Sam Clenny try and make a manure ARGUEMENT where it is apparent it is slam full of feces, attempting to justify why this case in Covington County could go forward when they have lost all of this evidence.


The Judge is taking under advisement but he even put on nose plugs with Sam defecating all over the courtroom.


TOMORROW



I intend to download and scan the court file and let you look at it. Folks, this I am literally ashamed of.


The Henry County Sheriff Department, Abbeville Police Department, Covington County Sheriff Department, The Henry/Houston and Covington County District Attorney Office, you have a responsibility to the people you serve and to the people you arrest.


The defendant is not what you have depicted him as. He is not what you have put him through. He is not what you have destroyed his career over your playing some game.


And the money you have cost this family, the mental anguish you have cost this family, his reputation that you have cost, each of you should be ashamed of yourselves. 


Sam Clenny, Doug Valeska, you each know better. And for you to throw the feces like you did in the Covington County courtroom today, your responsibility to the citizens and to those you attempt to destroy, is greater than what you have demonstrated in this case.


Sam - Doug, you are the final say. And Sam I know you have to ask Doug for permission for everything and can not make decisions without Doug's blessings.


But Doug Valeska,  if you allow this to continue one more day then you deserve a public caning on the steps of the Houston County Courthouse.


What I had seen in the record and knew was appalling. But as I read through this, I am going man...


Doug/Sam, this information being lost is not your fault. I will place blame where blame belongs: (1) Henry County Sheriff Department (2) Abbeville Police Department (3) Covington County Sheriff Department.


Adn I respect both Doug and Sam.


What I blame Doug and Sam for, the lack of integrity in allowing this to continue and not being a man with backbone and saying, this is not right and we move to dismiss.


It is time to do what is right.


FOLKS - I will catch heat over this article. But I refuse to sit by and allow such to happen without being exposed. I have met the defendant twice in my life, the day he was arrested and today.


But I am ashamed that the counties I live in would do this to someone. No excuse accepted. Do the right thing.
