A Motion to Dismiss Filed in the Ray Crosby Case

MONTGOMERY: Attorney Tommy Coggins who represented Defendant Ray Crosby in the bingo trials has filed a motion to dismiss count # 16 against the now deceased defendant Ray Crosby.
Judge Myron Thompson entered the following order: "ORDER TO SHOW CAUSE directing the government to show cause, if any there be, in writing by 2/3/2012, as to why defendant Joseph R Crosby's [2241] MOTION to Dismiss should not be granted. Signed by Honorable Judge Myron H. Thompson on 2/1/12".
Mr. Crosby was found dead in his Montgomery home by a friend Sunday. The friend says he believes he died of an heart attack which was stress related to this criminal case. The trial was to begin on Monday.
Just four days earlier Crosby filed bankruptcy. Crosby cited more than $ 600,000.00 in debt to include attorney fees.
At this time we do not know if the Washington D.C. Public Integrity Unit will object to the charges being dismissed against Crosby or not. If they object and the Judge denies the defendant's motion to dismiss, I wonder if they will require Crosby to be present for the trial?
The government's usual mode of operation, financially break you, then convict you. It appears Crosby was finacially broken. He then died.
We will monitor the government's response, if they do not file under seal.
