About The Barry Moore Trial

LEE COUNTY:    Next week Alabama State Representative Barry Moore will be on trial for Perjury. A offense said to have been committed to the Lee County Luther Strange Grand Jury. I have heard several people comment on the trial.


Some say, they have transcripts of what Moore said to the Grand Jury and the tape to Josh Pipkin. How is Moore going to defend the perjury case?


I do not know all of the facts, other than Moore had a conversation with Pipkin which was taped, and he later testified differently to the Grand Jury.


When I make this comment - who said what Moore told Pipkin was the truth? Moore could have lied to Pipkin and that is not a crime. But what Moore told the Grand Jury could have been the truth.


The people then comment, I have not thought about that.


The persecuters ( prosecutors ) have to first prove beyond a reasonable doubt, that what Barry Moore said to Josh Pipkin was indeed the undisputed truth. Once that is established, then they take his Grnad Jury testimony and prove he testified to something different, and that was a lie.


However, if the persecutors ( prosecutors ) can not prove what Moore told Pipkin was true, then it will be hard to prove perjury.


PART TWO


From my understanding part of what Moore told Pipkin was based on conversations and actions between Moore and Mike Hubbard.


With Mike Hubbard now under indictment, I do not think the persecutors ( prosecutors ) can force Mike Hubbard to testify. Hubbard can take the 5th.


I am not a lawyer, and from the looks of some folks who are, Len White, I have no desire to be one. However, for Moore to be guilty of perjury based on a taped conversation with Pipkin, I would think Strange will have to prove Barry was truthful with Pipkin.


It will be interesting to see...


ATTORNEYS


With Dothan's Scooter McCain, Derek Yarbrough and Bill Baxley ( in Birmingham but from Dothan ) they would not carry the case to trial if they did not feel good about their case.
