Arrested For Impersonating A Police Officer - WAIT - He Appeared To Have Public Approval

I just ran across this article where a Pleasant Grove Man was arrested for Impersonating a Police Officer. The article read the man was on a Crown Vic police car. In fact the officers thought the man worked for a outside agency.


The laws of the State of Alabama are a person shall be appointed by the Sheriff, Chief of Police, or the Director of the Alabama Department of Public Safety shall appoint and give the person the power to arrest.


However, in a recent court ruling in the 20th Judicial Circuit Court, the court states:


"there is a "De Facto Officer Doctrine". This doctrine, according to the Judge, would confer validity upon the acts of a Special Judge ( a police officer ) preceding under the color of official title, even if the propriety and legality of that appointment is deficient. Under this doctrine a de facto Judge ( police officer ) occupies a judicial office ( police job ) with credentials established under color of authority pursuant to an appointment. During the time the Special Judge ( police officer ) performs judicial ( law enforcement ) duties he is presumed to have public approval, even though his actual authority is statutorily deficient."



So my questions are, the law states the Mayor "shall" appoint but he does not. A person with zero authority to appoint makes the appointment and gives the man a black robe.


So the Judge of the 20th Judicial Circuit wants everyone to believe the law reads "shall", but "shall" does not mean "shall",, it means that someone without the authority appoints someone to be a Judge. Then when the janiotor, city manager, or sanitation worker appoints someone and gives that person a black robe or badge,  that person is a Judge, even though illegally appointed.


So if that is true, and the City of Dothan does not have to follow the law, then why was this man arrested for Impersonating a Police Officer. He was presumed to have public approval. He had a police car with lights, so it looked as he had the credentials for appearance and public approval. So with the Conaway ruling, looks gives authority.


And "shall" does not mean "shall" according to Judge Conaway’s ruling.


Shall means, Dothan screwed up and I have to save my fellow government cult members.

PLEASANT GROVE:    A Pleasant Grove man driving an unmarked blue Crown Victoria decked out with police lights was arrested today - by the real police.


Jonathan Cole, 36, was taken into custody on Park Road in front of Pleasant Grove City Hall. An officer on patrol spotted the vehicle – with emergency lights  activated -  and saw a man standing in the roadway. Inside the vehicle, said Lt. Danny Reid, was a bright yellow visibility vest with the word "POLICE" on it, and in the trunk was a book called "Forensics For Dummies."


Reid said the department had received complaints of an unmarked police car speeding through Pleasant Grove, and citizens thought it was the sworn officers. It all made sense, he said, when officers found Cole.


Initially Cole told Pleasant Grove officers he worked for a neighboring agency, but when they pressed him for details, he couldn’t provide them with answers. He eventually explained that he bought the Crown Victoria at an auction, and said it already had some of the police lights already installed on the outside of the vehicle. He then bought the lights to go inside the car, and purchased the "police" vest at a gun show.
