Arrested On federal Charges

MONTGOMERY:    On Thursday March 19, 2015 a Federal Grand Jury Indictment was filed with the United States Circuit Clerk's Office on Mason Cole Battles. The indictment was for Robbery and Assault.


On Friday, March 20, 2015, Attorney Derek Yarbrough offered to the FBI to turn Battles in on the Grand Jury indictment. While not being officially notified, it was rumored there was an indictment. However it is against the policy of the FBI to allow a person to turn themself in voluntary.


On Saturday, March 21, 2015 Houstn County Sheriff Donald Valenza was notified there was an indictment and the FBI requested assistance from the Sheriff Department in the arrest of Battles.


A young man who offereed to turn himself in but it is against FBI policy to allow someone to voluntarily surrender themselves on charges.


On Monday, March 23, 2015, at about 6:15 AM. three Houston County Sheriff Deputies and two FBI Agents went to Battles home and he was arrested on the Grand Jury Indictments. the indictments were issued last week, on Thursday.


Battles surrendered very easy and willingly walked out the door of the house to the officers. No resistance at all.


Two FBI agents transported Battles to Montgomery and after a brief stop at the Montgomery FBI Office, Battles was turned into the Unted States Marshall's Service.


Following his arrest, United States District Magistrate Court Judge Terry Moorer held an initial appearance.


Judge Moorer told the frightened young man that he did not consider Battles a threat to the community or someone that would be in trouble.


Judge Moorer said that he, as a Judge, fixes his name to the release and he takes the matter very serious. Judge Moorer said that if he felt Battles was a danger to the community or someone that would get into trouble, he would not sign the release.


With that said Judge Moorer released Battles on an unsecured $ 25,000.00 bond. Arraignment on the charges is set later in March.


Battles faces the same charges in Henry County Circuit Court. The allegations stem from an incident which is alleged to have occured at Hardridge Creek Campground. The State of Alabama filed Assault and Robbery charges in June 2014. Because the campground is on Federal property, now the FBI has filed charges against Battles.


At this time, Battles faces charges by both the State of Alabama and Federal Court. The same charges, the same incident, the same allegations in both courts.


The original incident is alleged to have occured in June 2014. The alleged victim is Kelli Whitehurst, a Rehobeth Elementary School teacher.


The Henry County Sheriff Department investigated the incident.
