CENTER STAGE - HEDA Files Brief Response To Alabama Supreme Court On Motion To Recuse

MONTGOMERY:   Today Attorney Ernie Hornsby and Ashton Ott filed a response brief with the Alabama Supreme Court on the Writ of Mandamus for Circuit Judge Mike Conaway to recuse himself from the case, State of Alabama ( Luther Strange ) versus Center Stage.

The issue before the local court ( Houston County ) is where the State of Alabama wants to take the some $ 283,000 plus dollars they took from Center Stage. Alabama Attorney General Luther Strange contends the money is proceeds from illegal gambling. However, the case has been stalled locally and moved to the Alabama Supreme Court.

The reason for the stall of the local issue and going to the Alabama Supreme Court is, HEDA Attorney’s have filed motions for Circuit Judge Mike Conaway to recuse from the case. So far, Circuit Judge Larry Anderson, Butch Binford and Brad Mendheim have recused from "this" case. All other Judges recused in the 2009 case that was filed in the Country Crossings case.

Until the Alabama Supreme Court rules, all local court proceedings are on hold.
