Cullman County attorney filed a civil lawsuit in a Montgomery County Court accusing Governor Robert Bentley of overstepping his bounds when he ordered the removal of the Confederate flag from the State Capitol grounds.
The filing, by attorney Melvin Hasting, says the Confederate Monument at the Alabama State Capitol “commemorates the 122,000 Alabamians who fought for the Confederacy during the Civil War.” He goes on to say the Governor had no authority to order the removal of the flags from the monuments.
Hasting asked the court to temporarily restrain the governor from removing or directing the removal of any “objects, monuments, sites, graves, bodies and landmarks concerning the history and heritage of the State of Alabama."
Hasting asked for a temporary restraining order against the governor's office, but a judge denied that request.
Hasting also named the Alabama Historic Commission in the lawsuit.
