When I listened to the closing arguments of the prosecution, the Gilley, the Pouncey, Massey, they sounded so pure, so credible, like you just wanted to hug them.  For one split second I forgot that these people were convicted felons, I forgot that these people wore sexist, racist, that they were liars, …  let me tell you something about Ronnie Gilley, he has got one more con left.  He conned the music entertainment industry, he conned the people of Alabama that his project was ok and was going to benefit Alabama, he conned these people right here, the last great con he is sitting at home sitting on the sofa waiting for you to bring in the verdict of guilty so he can say I pulled it off, I conned the jury.

 

The government says overwhelming guilty concerning HAS.  I don’t believe they have done that without  a doubt.  But I am going to tell you what they have done. These people from Washington have a found a great medical break through in this case.  UAB, Mayo Clinic have not been able to do it.  Do you know what that major medical breakthrough is?  It is a cure for memory loss.  Do you want to know how he did it.  There guinea pig Ronnie Gilley is on the stand.  And they ask if him if there was any bribing going on in 2009.  He said no.  Later that afternoon Mr. White asked him again if there were any bribes going on in 2009.  He remembers Benjamin Lewis. 

 

We break for the day and Gilley goes home and gets comfortable and he has is chicken salad sandwich.  Ummm good. And the next morning he comes in and he says you know what there were more bribes in 2009.  We had HAS connected with bribes with Lewis, Beason….

 

And he did not brush his teeth after he ate because he remembered after lunch Gilley being on the stand and he remembered one more..the 10 for 10. 

 

The government came in here and said HarriAnne Smith sold her hervote..oh I say nay! Nay!  I say nay nay to all of his testimony.  Think about a minute that every bit of this is based on untruths and I am going to show you about all of it.  Think about it that in their closing this morning they played one tape and if you blinked it was over think about that split second what HAS said, alright, thank you.   That is it.  The did not use the word cooberate one time in their closing statement.

 

Cooberate, let’s look at that.  Mr. Coker, how are you doing? 

Mr. Means, good to see you sir how you doing?

Mr. Preuitt, good to see you sir. 

Not one iota of conspiracy to do anything.  I’ve got to be honest to you, they have a tape, might not look good to us, the tape in HAS office where Gilley talks to Preuitt.

 

Milton McGregor, how you doing sir, oh HAS involved in that conspiracy there is the head man sitting right back there.  Two phone calls between him and HAS in two years.  One a phone call and one  VM… there it is there is their eveiidence.

10 – Government starts off and says in 2008 HAS comes up with a bill, completed on March 25, two SB572 and HB?? Both filed on April 3.  They presented this through Pouncey.  I love this.  What is SB572?  It is the destruction and death of bingo in Alabama.  What about the rest of the story…why didn’t they tell you the rest of the story.Do you remember that what happened was real simple.  Within a week she found out that the polls in Alabama showed the people wanted to vote on the issue.   She is against gambling., she doesn’t want gambling in her city.  But the  people had spoken.  She turned around and withdrew here bill.  They claim it was for money.  She had not met Gilley at this time, no money paid, not a deal.  She did it not because of Ronnie Gilley or anything involved with him, she did it because her people wanted to vote on it.  She did not agree with gambling, she let the people vote on it.

 

May 27, 2008…money raiser at Tartan Pines  in Enterprise.  Burying the hatchet meeting.  Gilley put his name on the invitation, he came up and handed money to her.  She had already come out and said she withdrew the bill and was going to let the people vote.

 

A few days later she goes by Gilley’s office and returns the check and tells him thank you but she could not take the check.  She thanked him for the ads against Jay Love.  She said some of her people would get with him and talk about her campaign. 

 

A week later he says she comes back and hugs his neck and says I am yours.  You know how I know she did not say I am yours to Ronnie Gilley, that is her husband sitting right back there and her valentines card to him did not even say I am yours…

 

Parkman goes on and talks about Gilley running ads and saying she may not want his support but that she has it. 

 

Parkman is talking about the checks that Gilley says were for HAS’s campaign and for the ads.  The checks are made out the Jarrod Massey.  You show me one bit of documentation that HAS ever got that money. 

 

You know what is interesting about 2008 and Gilley says he called McGregor at the end of 2008 early 2009, and Mr. McGregor said to Gilley how did you get HAS on board…wrong. 

 

Let’s go to 2009 now.  This is the chicken salad day.  Gilley had been working with the prosecution for almost a year when he came up here to testify and he forgot that on this particular day that he was to tell everybody that  HAS was to help bribe Beason, Lewis and the 10 for 10.  No con people make it up as they go. 

 

Let’s go to number 8.  Lewis and HAS.  This is great.  This is wonderful.  If you want to know how HAS talks to other politicians I am going to show you right now.  This is 3-24-09 a taped conversation.  Look at this, right here in the middle.  You can play it.  You’ve got to feel it in your heart like I do.  You don’t feel it in your heart like I do then you don’t need to vote for it.  Oh NO!  What has happened to the conspiracy….what has happened to our Senator that was going to bribe for us…Lewis says I see it, I see what you mean, if I don’t feel it in my heart, it would be wrong for me to vote for it.

 

This isn’t Chinese, it is not code her.  It is clear as a bell what she said.  Look at this.  I didn’t blow this one up because I ran out of money.  I want you to look at this.  This is that evil blonde over there trying to buy Mr. Beason’s vote.  Beason says I shouldn’t vote for this unless I read the bill..HAS says that you need to call Ronnie and tell him that he is having heartburn, that you are going to try to amend the bill and see if that works.  Leave the door open that there might be some Beason bills to make the bill work for Beason. 

 

Show me one thing where she puts pressure on Beason or Lewis to take a bribe.  Beason and Lewis have been recording everyone since 2009.  Where is the beef.

 

Try the testimony where Gilley says on 4-25-11 that he went to the FBI while he was in jail.  I told the FBI in 2011 that I told them that my support for them was uncondidtional..  Gilley says but wait, she knows I meant condiditonal…Parkman says show me where it was said.

 

J08.  Gilley talking to Beason, I haven’t offered her anything, I haven’t offered her a dime.  It is unconditional.

 

On J15 there is (2009) on this tape and she tell Lewis that she hadn’t taken a dime from these people nor am I taking a dime from them.  Now remember she is already supposed to be in the conspiracy in 2008.  Have you ever told your wife that you are never going to do anything again. And then a few days later something changes.

 

This is in 2009 and what happens toward the end of 2009 and January 2010.  Her Republican support pulls out on her because they do not like what she has done.  She doesn’t bow down to them.  She holds her head up and continues to run.  Is it so unusual that she needs money to run.

 

Let’s go to #7  10 for 10.  Gilley says he gave her 600 thousand dollars.  Lets take the money put in the fish ball…that leave 435,000.  Let’s take the in kind contributions..that doesn’t go to her.  Remember Gilley paid $47,000 for BBQ paid to a company he owned for BBQ.  And that tent…I will bring circus to your back yard.   Ok we are down to $200,000.  You remember the money  where he says she called and he wrote out checks for $200,000   Where is the money?  Show me the deposit slip where HAS got the money?  I asked the FBI on the stand..and they don’t have one.  That leaves us at $20,000. 

 

Look at the invitation.  69 hosts that hosted that party for her.  Why in the world would HAS want to hide anything and not let people know she knew Gilley.  His name is on here with 69 hosts and sent out to several thousand people.  

 

Why would she wanted to hide anything.  But wait.  Later he was on the phone and bragging about a fund raiser he had for HAS and exaggerate about it to others to make him look good. 

 

1-11-10.  this is great.  These are the checks that involve RABY.  They want to tell you that she got other money.  There has not been except from RABY one iota of testimony, especially from Ronnie Gilley, about these checks.  Gilley has not testified about these checks.  Let’s see.  The checks from Gilley were written on 1-11-10.  Raby’s Uncle on 1-10 wrote a check to HAS from the Tenn. Valley Authority.  Where are the checks from Ronnie Gilley.   They were written to the two PACS.  Do you have a separate checking account for each PAC, yes I do.   Then how could it be the same mone ?????

 

The government says that HAS is arranging for Beason to get some money.  They changed it a bit in their closing.  They say that Beason wants some money and HAS arranges a meeting for Gilley to meet Beason on Taylor Road.  After 10:00 the calls at 10:08, 10:18, 10:19.Whre was Mr. Gilley when he made those calls, The FBI agent said it says right here, the toll records say he was in Dothan, Alabama.  I said are you sure , he said yes.  No more questions from the government.  What I knew that they didn’t know was that he wasn’t in Montgomery, he was in Dothan.  So they change it up when they get up here today and say oh it happened the first of February.   Show me the tape between Beason and HAS,  He was taping everybody.  Show me the tape  They can’t.  It doesn’t exist.

 

Nest.  The meeting where they say HAS makes a call to McGregor to set up the meeting with Beason.  What is interesting is that she called Gilley and then McGregor to set up bribery with Beason.  Gilley says that a few days later he found out that HAS had called McGregor and it went well and she asked him for a campaign contribution.  Uhoh  we have a problem Houston.  Show me anywhere where HAS was at this meeting or that she was even invited to this meeting.   Remember this is the meeting with Gilley looks at Beason and says that HAS has not been asked to do anything, she hasn’t committed to anything nor does she want to do anything.  Uh oh!  Gilley says on the stand that that was a lie.  Gilley didn’t trust Beason.  Well Mr. White shows Gilley that in the previous proceedings he said that Beason was a stand up man..

 

I don’t really care whether he lied at the last proceeding or this proceeding, he is a liar and he lies and lies and lies.

 

They are going to conversation with Massey on March 31 where Smith says to Massey that she thought she would let him know that Mark Culver’s mother passed away.  She did not ask about the money or anything like that.   Number 4 never happened.

 

Call between HAS and Gilley. This is a call where Gilley and the government said that HAS called and demanded money by the next week. 

This is the call where HAS says that Gilley had told her he knew some other people that he could get to help her…. Smith says they are going to need another $400,000 to finish out the campaign, Parkman says and here is the bribe..here is the hit, And anything you can do will be appreciated. 

 

Do you know what is interesting about the indictment about this case?  The government said the checks were mailed from Houston County,  the indictments say they were mailed from Coffee County.  If they don’t know how do you.

 

I want to talk about French just a minute.  Oh she went and bribed Frenche.  3-10-10 Olive Room  guess who has been drinking?  Not her.  We have somebody else drinking all those gin and tonics or something out with olives.   Then the next morning on  3-11-10 we have an offer of a bribe.   Name me one person that even saw them talking…not one.

 

She is kicked out of the Republican Party just a few days before he goes to the FBI.  He calls and talks to Monica Cooper.  And he talks to Swinehart, he asks if HAS is wired.   Why would he be concerned that she is wired?  Could it be that he is concerned that he said something that he is concerned about in his drunken state and afraid that HAS is wired?   Where is the bribe?  Where is the wire?  Here is the key to this.  Mr. White asked Gilley on the stand the last time you never mentioned Mr. French did you?  I don’t recall.  Let’s go a step further, you never told the FBI about that did you?  I just don’t recall.

 

Then we go to the facebook with Flowers.  George Flowers.   We find out that Smith is on FB with Flowers.  French said that he did not do that.  In 2011 his campaign staff was talking to him…uh oh  we have a problem.  IN 2011 Mr. French did not have a campaign staff he had already been beat.  There are tapes were other people tell Gilley that French is in play, not HAS but Massey did.

 

There is no mention in anything in any tape that they have whether she is present or not of $500,000 to Beason.

 

Motive:  Why is Ronnie Gilley willing to help her besides the fact that she is from his district…Gilley hates Jay Love and the things he said about him and he would do anything to beat him.

 

George Flowers:  Gilley says he is going to make a oath right now that George Flowers ain’t going to get you in this election, You ain’t got to do a thing for me…but I want you to beat George Flowers.  The worst thing that could happen to Gilley is George Flowers to get elected and he is not going to let that happen.

 

Finally at the end of the talk you are going to find that MR. Beason calls the FBI about a call.  On 2-23-10 Beason says hey French what is up can you hear me.  Beason calls French two more times.  Why is Beason calling French.  Guess what folks…I am going to show you.

 

Monica Cooper, Scott BEason on J505 is talking about the issue of bussing the black people to the polls, every black, every illiterate.  HAS is not there, Monica Cooper is.  And guess what Steve French, before he calls the FBI calls Monica Cooper.  Guess who Scott Beason calls on the 23, Steve French.  And between these calls you have got Scott Beason, Benjamin Lewis and they are talking about those Greene county Blacks, they are your Indians.  And now who is in the middle of all of this,  Ronnie Gilley…It all ties together.

 

There is a text message about $400,000 that went to everybody..she did not send it.  Swinehart and her campaign manager did it…four 50,000.    50,000 went in the Tennessee Valley PAC,  $90,000 come out.  Guess who directs all of this money.  Swinehart and Hartsell her campaign manager directed all of this.  And what did Raby say about this.  He said there is nothing illegal about this.  We have been doing this in Alabama for years.  How can you deposit $50,000 in the Tenn Valley pAC and take $90,000. 

 

I know you are tired, so am I.  The government is going to get a chance to talk to you one more time.  I can’t do that.  I am going to extend some Southern Hospitality to these people.  They have given you only have the truth but that is all they know.  I am going to give them a chicken salad sandwich.  I am going to sit it right there.  If they don’t take it or eat it then they don’t want to know the truth.  I showed you what evidence does, I showed you the truth.  To every count he listed in this case I say NOT GUILTY!  NOT GUILTY!  NOT GUILTY!  Thank you your honor…
