Florida Attorney will Voluntarily Surrender His License to Practice law

On 09-17-2014 the Marianna Police Department received a report of the misappropriation of multiple estates monies from a trust account by Attorney at Law Thayer Mervin Marts.  Marts had an office here in Marianna at 2869 Jefferson St. Marianna, Fl. 32448 and another in Tallahassee at 1105 Hays St. Tallahassee, Fl. 32308.  On 11-10-2014 a search warrant and arrest warrant was served at the Marts’ Tallahassee Office.  Marts was arrested and charged with Grand Theft in reference to a single estate approx. $41,000.00 dollars owed to the heirs of that estate.  Marts was transported to the Leon County Jail awaiting transportation to Jackson County and first appearance. 


This investigation is still on going and additional charges are pending in another identified estate case.  However, there are another thirteen estates that may have been affected by this theft.  Anyone having conducted business with Thayer Mervin Marts and still having an open estate case is urged to contact the Marianna Police Department.  Efforts will be made to contact heirs to these other estates, but sadly in a few of these cases there are no heirs on record.


During the course of this grand theft investigation it was learned that 79 year old Marts had been suspended from the practice of law by the Florida Supreme Court while the Florida Bar Association investigated Marts based on a complaint received earlier in the year.  Later it was learned that Marts submitted papers to the Bar and will voluntarily surrender his license to practice law.


The Marianna Police Department and Chief Hayes Baggett would like to thank the Florida Department of Law Enforcement whose help was instrumental in the success of this investigation.
