Hubbard Legal Team Seeks Evidentiary Hearing

The defense team for House Speaker Mike Hubbard (R-Auburn) is requesting an evidentiary hearing regarding what they describe as “prosecutorial misconduct” by prosecutors with the Alabama Attorney General’s Office.
On Wednesday, Hubbard’s attorney Mark White filed a supplemental proffer in Lee County Circuit Court to request the hearing. In the proffer, White cited a state Personnel Department appeal by Gene Sisson, a former investigator with the AG’s office, along with court transcripts regarding Keith Baker, a former special agent with the FBI who is now with the office.
Sisson, who was terminated by the AG’s office, testified on July 13. White said a “substantial amount of testimony provided at (Sisson’s) public hearing touched on matters which have formed the bases of Hubbard’s various motions to dismiss” the 23 ethics charges on which the speaker was indicted last year.
» In Sisson’s public hearing, witnesses reportedly claimed that Attorney General Luther Strange found the use of profanity in his office “unbelievably objectionable” and a “violation of our policies.”
Former Deputy Attorney General Sonny Reagan reportedly claimed that Acting Attorney General Matt Hart stated the “correct way to handle Hubbard was to ‘Bring him in, show him the drafted indictment and tie the noose around his (expletive) neck. Then cinch it down until he is grasping for (expletive) air. Then give him an option to plead guilty and resign.’”
» Witnesses also stated that Strange commented on the “confidentiality obligation” that employees have to “safeguard” any information they have “privy to working in a law enforcement environment.”
Reagan claimed that Hart admitted to working “in concert with reporters to reveal information regarding the grand jury to the press to help his case,” according to court documents.
