Judge: Arguments in Rickey Stokes' unlawful imprisonment case ‘very rare’

A bizarre legal case involving a local bondsman in which the City of Dothan filed motions arguing both sides of an issue may be headed back where it started.


Special appointed Judge Aubrey Ford heard arguments Friday in a case involving the City of Dothan vs. Rickey Stokes.



Stokes was arrested in June of 2014 and charged with two counts of unlawful imprisonment after chaining two black men to the front door of the city’s municipal courtroom as part of a feud between Stokes’ bonding company and the local court.




Special appointed Judge Carl Chamblee Jr., found Stokes guilty in September of 2014 and sentenced Stokes to 10 days in jail and a $500 fine on each count. Stokes appealed the conviction to Houston County Circuit Court.




Meanwhile, Stokes discovered that Dothan’s city manager was the appointing authority for Judge Chamblee to hear the case, while state law limits the appointing authority to the mayor. Chamblee was appointed because the local municipal judge recused herself. Stokes filed a lawsuit in federal court, claiming his case was void and seeking damages for costs incurred defending himself. The suit seeks class action status for all others prosecuted by a special judge appointed by someone other than the mayor.

COMMENT FROM RICKEY STOKES


The members of the Dothan Commission have allowed Dothan City Attorney Len White and members of the Dothan Legal Office, from Jun 13 through Julu 31, 2016, to spend               $ 25,000.00 with the law firm Copeland, Franco, SCrews and Gill of Montgomery Alabama on this matter and the federal lawsuit caused by Len White and the Dothan Legal Staff.


That $ 25,000.00 does not include billing from 7/31/2016 to date. And all of the that on fighting Rickey Stokes. When this issue could be resolved very simple.


But the Dothan Commission have their heads in the sands and buttocks in the air and will not get control of the Legal Department and Municipal Court, even though many great minds in Dothan have told them.


The Dothan Commission pretends it is not happening, while all the while the citizens are forced to pay unnecessary money.


I only want the problems fixed. So while this is costing Dothan unnecessary money, the Dothan Commission will try and blame Rickey Stokes.


But I have tried to get the problems fixed, and GOD as my witness, this waste of money is the fault of the Dothan City Commission - Kevin Dorsey, Amos Newsome, Albery Kirkland, Mike Schmitz, John Ferguson, Beth Kenward and David Crutchfield.
