Judge Aubrey Ford A NO SHOW In Court - Which Prevents Official Records Of Facts

DOTHAN:    The issue is long and hard to explain. 


In the case of City of Dothan verses Rickey Stokes court was scheduled in Houston County. The time was 8:30 AM, Courtroom 311 of the Houston County Courthouse.


The appointment of the judge in the case that was tried in Municipal Court was illegal and improper. When I appealed the case from Dothan to Houston County Circuit Court, the City of Dothan "certified" the records were true and correct.


The Alabama Administrative Office of Courts appointed retired Circuit Court Judge Aubrey Ford to hear the case.


The Stokes legal team filed a Motion to Dismiss the appeal based on the fact the City of Dothan did not transmit the records to the Houston County Circuit Court on time. Dothan objected, once again certifying to the Circuit Court they had "certified" the records correctly and on time.


Without any hearing or testimony on the issue, Retired Macon County Circuit Court Judge Aubrey Ford denied the Stokes motion to dismiss.


The Stokes legal team then filed a Motion To Reconsider the order to dismiss, that Dothan did not transmit the records on time. And with that motion the Stokes legal team filed court transcripts from the court hearing in Dothan Municipal Court. The Stokes team asked the court for an immediate hearing. This was filed on June 1, 2016.


Retired Macon County Circuit Court Judge Aubrey Ford issued an order for the Stokes motion to be considered June 16, 2016 at 8:30 AM prior to the trial.


When the City of Dothan found out the Stokes legal team found the appointments for Acting Municipal Judges was not legal, the City of Dothan filed for the case to be dismissed and remanded back to Dothan Municipal Court. The City of Dothan wants to try Stokes again in Dothan Municipal Court.


On June 13, 2016, retired Macon County Circuit Court Judge Aubrey Ford, without hearing any testimony, granted the motion of the City of Dothan.


Today, June 16, 2016 at 8:30 AM, Stokes appeared in the courtroom where Judge Ford scheduled the hearing on the motion filed by Stokes. No one was there, to include retired Circuit Court Judge Aubrey Ford.


COURT OF NO RECORD


A municipal court is a "court of no record". That means, testimony in a Municipal Court is not recorded by a court reporter.


But the Stokes team hired a court reporter to be in the municipal court in order to have a factual transcript of what occurred in court.


By retired Circuit Court Judge Aubrey Ford not honoring his order of June 7, 2016 for the Stokes motion to be heard "on the record in front of a court reporter", Judge Ford has denied an official record to be made of the true and correct facts.


In Circuit Court, there is a court reporter. That record is to reflect all that is said. And when there are issues, that record is what the appeals court reviews. The appeals court does not have testimony.


With Judge Ford being a "no show", he has violated the constitutional rights of Stokes, and has further proven that often times court are not about honesty and integrity.


The Stokes legal team has paid close to $ 1,000.00 for court reporter and transcripts in the trial in Municipal Court.


And today was important to "create a record" of the true and accurate facts. But Judge Ford’s actions further implicate the dishonesty of some of those in the court system. And his actions further demonstrate how people get abused in the court system. 


Stokes was present and ready in court to present his testimony of true and correct facts.



EX PARTE


The bad part is, Judge’s hide behind this "ex parte", they cannot talk with a party without the attorney present from both sides.


Exactly what Stokes attempted to do, and expected to have done in court today. It was not Stokes that was afraid, it was the City of Dothan and Judge Aubrey Ford who were afraid of having the hearing in front of a court reporter where there was an official record of what was said.


So the Ex Parte rule, and the court having the power to abuse people and not allow their day in court in order to create a record, proves for dishonesty in the courts.
