HOUSTON and HENRY COUNTY: Do you have the ability to read the following?
Section 12-14-34
Acting municipal judges.
In the event of the absence from the municipality, death, disability or disqualification of a municipal judge for any reason, the mayor of the municipality shall have the authority to designate a person, licensed to practice law in the state and a qualified elector of the state, not otherwise employed in any capacity by the municipality, to serve as acting municipal judge with all power and authority of a duly appointed municipal judge. No such acting judge may serve for more than 30 successive days or a total of 60 days in any calendar year; provided, that when the duly appointed municipal judge is disqualified pursuant to the Constitution, the time of service limitations for acting judges shall not apply during such disqualification.
(Acts 1975, No. 1205, p. 2384, §8-111.)
That is the laws of the State of Alabama in which Mike Conaway took a oath to obey. And he pens a court ruling that said a judge not appointed in accordance with the law, writing " During the time the Special Judge performs judicial duties he is presumed to have public approval, even though his actual authority is statutorily deficient".
Judge Conaway also pens " There is no record to show that the Defendant was denied due process or any constitutional rights".
A COUPLE OF THINGS
1. When Judge Conaway tells a defendant they "shall" report to the Probation Officer within 24 hours. Does he mean they may, they presume they appear, or they can send someone else in. Of does he mean the defendant "shall" appear in person.
2. If I put on a police uniform, and the custodian signs a paper appointing me as a Police Officer, does that mean because I turn a blue light on and pull someone over that I am presumed to have public approval to make traffic stops and arrest people, even though the person who said I was a police officer has no statutory authority to say I am a police officer.
3. Judge Conaway said there is "no record to show Defendant was denied due process or any constitutional rights". Will someone inform Judge Conaway, unless the defendant hires a court reporter that Municipal Courts have no court reporters, so therefore Judge Conaway has no record to show anything of such.
No transcript of the court hearings at all. None. So for Judge Conaway to make that statement, he has no record to truthfully and accuratley say at all if that Judge violated any rights.
4. Judge Conaway pens "rights may be forfeitued in criminal as well as civil cases by the failure to make timely assertion of that right". Who would have ever thought that the Legal Department of the City of Dothan or the Trussville Municipal Court Judge did not know how to appoint an Acting Municipal Judge.
And I went to the Magistrate Office for the records, was told the records were in the Judge's Office. When I asked the Judge a prosecutor was there. Judge Gordon said the records were in the City Manager's Office. At the City Manager's Office I was told the records were in the Judge's Office.
So I then went to Finance to see the payoff from the City of Dothan to the Trussville Judge to see if the order was enclosed, only to be told that Len White and Joe Herring said do not give it to me and I would have to issue a subpeona.
So based on Judge Conaway's absurd ruling in this case, a person needs to object to everything: I object to your wearing a black robe, being in the courthouse, being on the fourth floor, having the color carpet, that you were not legally elected, and to everything under his rationale.
Judge Conaway has made a bad and inaccurate ruling in my opinion and screwed the goose in this case and violated people's rights.
The citizens have a expectation to honest government and honest judicial activities. Not ones that say, well it is okay for us in the system to be stupid and not know what we are doing, but it is not all right for you.
VOMIT
I respect Judge Conaway but this is beyond comprehension to approve Dothan violating the law.
