Former Mobile County Commissioner Stephen Nodine will be retried on his murder charge in Houston County, Baldwin County Circuit Judge Charles Partin ruled today.

Partin scheduled Nodine’s trial for Sept. 10 at the courthouse in Dothan.

Nodine faces charges of murder and aggravated stalking in connection with the Mother’s Day 2010 shooting of Angel Downs, a Gulf Shores real estate professional who had carried on a yearslong affair with him.

Defense attorney John Beck, who had argued that his client could not get a fair trial in Baldwin County because of the enormous amount of publicity that the case has generated, praised the ruling.

“I just don’t think the judge had any choice in the matter,” he said. “The (media) saturation has been profound.”
