On February 1st, 2013 at approximately 12:09pm, Officers with the Marianna Police Department received a call in reference to possible drug activity in the laundry room located between D and E Building at the Marianna Gardens Apartments. Upon officers’ arrival, contact was made with three black males inside the laundry room. Two of the subjects, Dimitrius Johnson-Luna and Gary Davis Jr., were found to have trespass warnings for the Marianna Gardens Apartments. Both subjects were arrested for Trespass After Warning.
While officers were speaking with the third suspect, Johnathan Shack, Shack advised officers of some marijuana that he had in his pocket. Officers retrieved 5.9 grams of marijuana from inside two different plastic sandwich bags, from the pants pocket of Shack. At that time, Shack was placed under arrest for Possession of Marijuana.
During a search of the laundry room and its contents, officers located a plastic sandwich bag that contained several small bags of marijuana. It was found that the plastic bag contained forty, individually wrapped, small, green zip lock bags, all of which contained marijuana. Along with the marijuana, officers located forty five dollars in cash, a digital scale, and a cell phone. The total amount of marijuana located was 33.2 grams.
During this investigation, Shack admitted to the pre-packaged marijuana being his. Due to the amount of marijuana located and due to being within 1000ft of a school, Shack was charged with Possession of Marijuana More Than 20 Grams With The Intent To Sale Within 1000ft of a School.
Shack, Johnson-Luna, and Davis Jr. were transported to the Jackson County Correctional Facility to await first appearance.
