Motions Denied In Brackin Case

HOUSTON COUNTY:   All motions denied.


Today formed Dothan Attorney Randy Brackin was before the courts. Before the court were Motions For A New Trial and Motions To Alter Sentence.


Backin was charged with Possession of Child Pornography, 10 counts.  A Houston County jury convicted Brackin on April 22 on all 10 counts.


Brackin was sentenced to 10 years on each count, all sentences to run concurrently. He was sentenced to serve 13 months in Houston County Community Corrections followed by five years supervised probation.


Today Special Appointed Circuit Judge P.B. McLaughlin heard arguments on the motions before the court. After hearing testimony the Judge denied all motions.


There has been some dispute on Brackin serving his sentence through Houston County Community Corrections. Today the Director, Gary Knight, said the order would present some challenges, but if ordered by the court those challenges would be met.


Brackin has appealed his cases to the Alabama Appeal Courts. Until a ruling he remains free on appeal bonds.


Brackin still faces 10 more counts of Possession of Child Pornography. Those cases have yet to be scheduled for trial
