DOTHAN: On Monday 20th Judicial Circuit Court Judge Mike Conaway dismissed the appeal of Amos Newsome and remanded the case back to Dothan Municipal Court.
The prosecutors representing the City of Dothan never informed Judge Conaway that Newsome conviction in Dothan Municipal Court was fraud.
I alerted counsel for Newsome who was not aware that Judge Conaway had a docket call two weeks before trial date. Newsome Attorney knew the case was set for August 8, 2016 but did not know there was a docket call.
Newsome Attorney filed a Motion To Re-Instate The Appeal. That motion was granted by Judge Conaway.
DOTHAN LEGAL DEPARTMENT CONTINUES THEIR FRAUD
The City of Dothan operates under the laws of the State of Alabama. Those laws call for Acting Municipal Judges to be appointed by the Mayor.
In Newsome case the Acting Municipal Judge was not appointed as per Alabama Law. The Mayor never appointed the Acting Judge. The appointment was made by Dothan City Manager Mike West.
That blunder by the Dothan City Attorney and Dothan Municipal Court makes Newsome conviction in Dothan Municipal Court void.
On Monday Dothan Prosecutors were under a obligation to be honest with Judge Conaway. However they continued a pattern and practice of dishonesty and never informed Judge Conaway. And apparently the continued practice of dishonesty practiced by the Dothan City Attorney Office is rubber stamped by the elected officials of the City of Dothan.
They continue to allow Freddie Len White's Office to continue.
