No Same Sex Marriage License In Houston County

HOUSTON COUNTY:   Houston County Probate judge Patrick Davenport is not issuing same sex marriage license today.


Alabama law does not require Alabama Probate Judges to be attorneys. However in Houston County Judge Davenport is a licensed attorney in the State of Alabama.


With conflicting direction from the Alabama Supreme Court and the United States Federal Court, Judge Davenport is waiting on clear legal directions on what to do.


The Probate Office is taking applications and will contact the parties requesting license once a clear direction is given.
