NOT GUILTY So Says The Jury Of Peers

HOUSTON COUNTY: A Houston County Jury today returned a NOT GUILTY verdict in a Rape in the First Degree case today.
In a case where 17 year old Demarcus Barber was represented by Tom Smith of Smith and McGhee, the jury of 12 peers returned the not guilty verdict.
The case tried before Twentieth Judicial Circuit Court Judge Kevin Moulton was where Barber was charged with forcible rape of a 19 year old. Attorney Tom Smith presented the facts that the sex was consentual between the 17 year old and 19 year old female. The victim testified that the defendant spent almost every day and night with her.
On this particular occasion the victim testified that she said "no". The defendant said he thought she was playing like she had before. Then the victim tesitfied that she had a seizure during sex and the defendant said she did not.
After the case presentation and representation by Tom Smith, the jury of 12 deliberated and so said NOT GUILTY.
