On Page 4 Attorney General Proves Any Idiot Can Be A United States Spreme Court Judge

LEE COUNTY:   This afternoon I was reading the court files in the Mike Hubbard ( Alabama Speaker of the House ) case. The defense filed a motion to continue arguing that more time was needed to prepare the defense. Naturally the Attorney General’s Office argued that the defense has had plenty of time to prepare for trial.

When I was reading the 22 pages of the Attorney General opposition I was amazed at one case they cited as a reason to deny the continuance. I will feature that reason a little later in this article, but it will destroy your faith in the judicial system and the wisdom or lack thereof in some of the judges.

Interesting fact:   The Lee County Grand Jury was formed on Jul 29, 2013 to begin looking into matters with Speaker Mike Hubbard.

Indictment:   The Lee County Grand Jury returned the 23 count indictment against Speaker Mike Hubbard on October 17, 2014.

Arrest:   Speaker Mike Hubbard turned himself into custody at the Lee County Sheriff Department on October 20, 2014.

It would not be until after October 20, 2014 the defense team of Speaker Mike Hubbard would be given any documentation whatsoever to begin reviewing on the allegations against Hubbard.

It is the responsibility of the State of Alabama to provide the defendant with each and every allegation, and the defendant be afforded an opportunity for a fair and impartial trial.

What is alarming and damages the credibility of all courts, in the states objection, page 4 begins the description of a death penalty case:  "Demonstrating the breadth of discretion afforded to trial courts, the United States Supreme Court has affirmed a death sentence in a case originating in Alabama when appointed counsel had only three days to prepare for trial. See Avery v. State of Alabama, 308 U.S. 444 ( 1940 ), In that case, as in this one, defense counsel moved for a continuance and attached affidavits stated as follows; ( see page 5 for the affidavits ).

Despite the affidavits, the trial went forward as scheduled on Thursday, March 24, resulting in the defendant being found guilty and sentenced to death...after considering the affidavits and the facts and circumstances of the case, the Supreme Court affirmed the death sentence".

The Attorney General has 6 Attorney Generals listed on the case action summary as the defense has 6 defense attorneys listed. The court file has 706 motions and motion transmittals listed. There is a lot of material to be reviewed in this case. The Attorney General had 15 months of Grand Jury before indictment.

Since indictment, the defense has had almost 18 months since arrest. And you can bet when the Grand Jury handed down the indictment the Attorney General had a  lot of what they needed. So the time from arrest until now, and the seeking a continuance is not out of line as compared to the time the Attorney General has had.

Now, back to what shakes the faith in Judges and their decisions. The case cited by the Attorney General, does anyone really believe that a man got a fair trial, with a court appointed attorney, with appointment to trial being 3 days? And he was sentenced to death and the United States Supreme Court believed that was adequate.

In my opinion, that proves a idiot can be a United States Supreme Court Judge
