Order of Judge Conaway In Regards To Motion of AG and Motion Of HEDARickey Stokes

DOTHAN – HOUSTON COUNTY: Twentieth Judicial Circuit Judge Michael Conaway entered an order in reference to motions filed.
The Alabama Attorney General Office filed motions seeking to preclude HEDA from the introduction of evidence at the hearing set for September 26 and to quash subpoenas issued by HEDA for September 26.
The evidence HEDA wished to introduce was evidence concerning the appointment of Mike Conaway as Circuit Judge of the Twentieth Judicial Circuit. Conaway was appointed as Judge in 2010 by then Governor Bob Riley. Judge Conaway blocked the introduction of that evidence.
HEDA also issued subpoenas to the three persons which interviewed Mike Conaway for the appointment as a Judge in the Twentieth Judicial Circuit. The three which subpoenas were issued for were Josh Blades, Ken Wallis and Sonny Reagan. All three were members of former Alabama Governor Bob Riley’s Staff and conducted the judicial interviews. Interestingly Sonny Reagan is a member of Alabama Attorney General Staff and the lead prosecutor in the forfeiture case involving Center Stage. Judge Conaway blocked that motion.
HEDA also issued subpoenas for Mike Conaway and John Watson. The subpoenas were issued concerning a business relationship between Conaway and Watson. The order granted the motion of the Attorney General to quash the subpoenas.
HEDA filed a motion seeking a stay on the hearing of September 26 set by Judge Conaway. The delay sought by HEDA was to give them time to file a Writ of Mandamus seeking the removal of Judge Conaway to hear the case of Center Stage. Judge Conaway denied the motion of HEDA.
To file a Writ of Mandamus, the petitioner has to file with the trial court seeking a stay of the hearing. With the order of denying the motion of HEDA, they will file with the Alabama Supreme Court Motions To Stay the September 26 motion.
