DOTHAN: Part Three of Dothan Commissioners continuing to allow Freddie Len White and Joe Herring to place the citizens and their children of Dothan at risk. At risk of financial ruin for inadequate legal representation.
In the case of City of Dothan verses Commissioner Amos Newsome, the documents in the case are for your viewing.
Newsome was charged with "clawing" WTVY News Personality Ken Curtis. Newsome's claw was after Curtis violated Newsome's personal space as Newsome was attempting to get into his vehicle.
Newsome was arrested. Since he is the employing authority of Dothan Municipal Court Judge Rose Evans-Gordon, she recused herself from the case.
That required an Acting Municipal Court Judge. The Legal Department of the City of Dothan, Len White and Joe Herring, allowed Dothan City Manager Mike West to make the appointment. They never told Mayor Mike Schmitz that it was his responsibility to appoint the Acting Municipal Judge.
White and Herring were absent from law school they day they taught how to read and understand simple laws!
Dothan City Manager Mike West appointed Trussville Municipal Court Judge Carl Chamblee to act as the Judge in the case of Commissioner Amos Newsome. And Chamblee was the same Judge that convicted Rickey Stokes.
Newsome was charged with a Class A Misdemeanor which carries jail time up to one year in the Dothan Municipal Jail and up to a $ 6,000.00 fine. The illegal Acting Municipal Court Judge gave Newsome a suspended sentence, and 14 days to appeal. Newsome was convicted of an offense that caused physical injury to Ken Curtis.
Stokes was charged with a Class C Misdemeanor which carried jail time up to 30 days in jail and a fine up to $ 500.00. The illegal Acting Municipal Court Judge gave Stokes 10 days to serve in the Dothan Municipal Jail, refused 48 hours to turn himself into the custody of Dothan Police but ordered Stokes in custody immediately. Stokes appealed and posted the two $ 500 appeal bonds.
After Newsome's conviction and after Rickey Stokes found that White and Herring were giving Mayor Schmitz and Dothan Commissioners awful legal advise, and Stokes was onto the appointment of Acting Municipal Court Judges, Dothan filed a Motion To Dismiss Newsome's Appeal in Circuit Court and remand that appeal back to Municipal Court.
Newsome's Attorney filed a Motion To Dismiss the case because of White and Herring's awful and not credible legal advise to Mayor Schmitz and the Dothan Commission
Then Dothan filed an objection to Newsome asking for the case to be dismissed.
Newsome's cases were set before 20th Judicial Circuit Court Judge Mike Conaway. After getting the motions, Conaway have the attorneys 10 days to filed brief's. The parties asked for additional time to file the brief. That motion was granted.
The City of Dothan has filed the brief. Judge Conaway so far has not issued a ruling on either the motion of the City of Dothan or Defendant Amos Newsome.
