Stephen Nodine murder charge: Judge rejects allegations of prosecutorial misconduct

This trial will be held in the Houston County Courthouse in Dothan Alabama. It involves a former Mobile County Commissioner.
BALDWIN COUNTY: Rejecting arguments that then-Baldwin County District Attorney Judy Newcomb withheld key evidence from the defense, a Baldwin County judge today denied an effort to throw out a murder charge against former Mobile County Commissioner Stephen Nodine.
“Based upon the foregoing findings, the Court is of the opinion that the prosecution in this case has not been guilty of any misconduct that would warrant a dismissal of the indictment,” Circuit Judge Charles Partin wrote.
In a written statement, Nodine said that proving prosecutorial misconduct is a high burden to meet. But he expressed confidence that he will be exonerated when the case goes to trial in September.
“Though we were not successful in getting the charges dismissed, the ruling clearly is moving in our favor,” Nodine wrote.
