The 2012 Bingo Trial - The Actions of the Public Integrity Unit is in serious question

MONTGOMERY:   After reading what the juror has said in today’s Montgomery Advertiser, the following has to be said. So far, all media has been afraid to address this issue because everyone is afraid of the federal government and those in power.

Government, but I can no longer sit idle and be afraid of what they will do to me.

1.       It has been documented in other cases, as in this case, prosecutors have had allegations that they broke the law in the botched corruption case against former Alaska Senator Ted Stevens.

2.       It has been documented in other cases the Washington D.C. Department of Justice admitted its attorneys had improperly concealed evidence that could have helped the defense of Alaska Senator Ted Stevens.

3.       It has been documented the attorneys in the Stevens case, which the Washington D.C. Department of Justice has spent $ 1.8 million dollars defending, have been involved in the Alabama bingo case. Two of those attorneys being Brenda K. Morris and Peter Ainsworth.

4.       In the Alabama Bingo case, Washington D.C. Public Integrity Unit Prosecutor Peter Ainsworth was removed from the Alabama case after Alabama Federal Judge Wallace Capel threatened sanctions and called him an embarrassment for withholding evidence in the Alabama case.

5.       In the Alabama Bingo case,  now Washington D.C. Public Integrity Prosecutor Justin Shur left the security of the government job to enter private practice as information similar to the Alaska case surfaced. Evidence not being disclosed that would have helped the defense in the Alabama case.

6.       The USA Today has documented 201 criminal cases in which Judges determined that Justice Department Prosecutors, the Nations most elite and powerful law enforcement officials, themselves violated laws or ethics rules.

7.       It has been documented, the Washington D.C. Public Integrity Unit withheld evidence in the 2011 trials that would have exonerated Ray Crosby. A man that died one week ago, a financially broke man, a scared man, who the Public Integrity Unit withheld evidence that would have exonerated him and others. That exoneration has been verified by a juror in the 2011 trials which is highlighted in today’s Montgomery Advertiser.

8.       At the beginning of the 2011 Bingo Trials, Judge Myron Thompson announced in open court, the parties had to take the matter of Keith Baker, the lead FBI Agent, and the Grand Jury up before the trial started. The parties went outside the courtroom into private. The matter is under seal. But when they returned, the lead FBI Agent was no longer in the courtroom, never appeared in the courtroom until the trial was over, and never testified. No one will reveal the matter but there have been a lot of rumors.

9.       Based on the rumors, many media members have searched for information. Some key piece’s to support those rumors have been found: (A) The defendants were arrested on October 4, 2010, about 30 days before the Alabama General Election where the Republicans wanted to take control of Alabama Government (B) The defendants were ordered by the court to not talk with any candidate running for office (C) The Washington D.C. Public Integrity Attorney’s, those prosecutors under investigation for corrupt practices, stopped a constitutional amendment from passing the Alabama Legislature. Legislation that Senator Scott Beason later taped himself as saying if this legislation had passed it would have brought “aborigines” ( blacks ) out to vote which would hurt the Republican take over of Alabama government.(D) Republicans take over the Alabama Government, but then…

10.   The hearing about FBI Keith Baker and the Grand Jury. Rumors have flown that the secrecy of the Grand Jury process was tainted and information that, by law is secret, was revealed. All defendants and attorney’s refuse to disclose what is under seal for fear of going to jail. But all media have heard rumors. The following supports those rumors: (A) The defendants were arrested on October 4, 2010. (B) On November 5, 2010 FBI Agent Keith Baker’s wife ( we will not release her name because that is not fair to her, she is not involved in this case ) filed for a divorce in Elmore County, case number 29DR 2010-900213.00, public record. She was represented by Montgomery Attorney Floyd Minor. (C) The allegations were, Keith Baker moved out of the marital residence on October 12, 2010, some 8 days following the arrests. (D) Then on November 17, 2010 Attorney Floyd Minor withdrew as representing Mrs. Baker. (E) On December 2, 2010 Attorney Judy Barganier entered her appearance of Mrs. Baker and moved for the divorce to be dismissed. That motion was granted on December 3, 2010.

What is so special about the timeline of # 10 and the names of the persons involved? Attorney Judy Barganier is the wife of Alabama Bureau of Investigation Agent Joe Herman. ABI Agent Joe Herman is the agent assigned to be a partner of FBI Agent Keith Baker in this trial. While Mrs. Baker was represented by an attorney, that attorney withdrew and then Herman’s wife represented her husband’s partner’s wife in having the divorce dismissed.

The rumors are, Baker leaked Grand Jury testimony to former Alabama Governor Bob Riley, Grand Jury testimony that was leaked to Baker, from an inside source of the Grand Jury. Grand Jury is secret and not to be disclosed.

Then that leads to why Alabama Attorney General Luther Strange fought so hard to prevent former Alabama Governor Bob Riley from testifying in the case, and why the Washington D.C. Public Integrity Unit did not call the lead FBI Agent Keith Baker to the witness stand.

DISCLAIMER:  We can not confirm this because Judge Myron Thompson has this under seal as to the reasons of the hearing for Kieth Baker and the Grand Jury. However, in the discussions with media members, we all have heard basically the same thing. Even names of the party that leaked the information. None of us have anyway to confirm that information. But the court records can prove the information right or wrong, and I would love to proven wrong. Because right now, my opinion and the opinion of a lot of media, the corruption so far is on the side of the Washington D.C. Public Integrity Unit. A corruption that has been proven before in other cases.

No defendant or attorney will confirm the hunch, they will only say the matter is under seal and they can not comment, and will not go to jail for commenting.

However, when you look at the time lines, when you see the parties involved, when you notice things different, when you see information withheld, when you look at the history in other cases, you can make reasonable assumptions to what has happened.

11.   All Alabama Prosecutors from the United State Attorney Office have removed themselves from any involvement in this case. The only prosecutors in this case are from Washington D.C. Public Integrity Unit. When you look at the time line, when you look at what has happened in this case, it is obvious things from the government just ain’t what it is suppose to be.

12.   Look at the comments of Former Governor Bob Riley and Representative Mike Hubbard before the investigation and details broke, look at the sworn testimony of Benjamin Lewis as to who knew he would get the Judge appointment, look at their pre-arrest statements and comments, and the see if they did not have an inside track to what was happening in the Grand Jury process.

13. Now the Washington D.C. Public Integrity Unit, which is allowed to by pass the media by slipping in the back of the courthouse, wants a gag order placed on the defendants and their attorneys. The defendants and attorneys are required to enter through the media. Why does the court make one set of operatives follow one rule and face the media three times a day, but allows the Washington D.C. operatives to by pass the media?

Federal Judge Myron Thompson is a smart man. In a conversation with a friend of his just yesterday, we both agreed he is very smart man. But we both agreed that Judge Thompson has failed to hold the Washington D.C. Public Integrity Unit and their operatives to the same standards as others in this case. We both agreed that Judge Thompson should send the Washington D.C. Public Integrity people back to Washington with orders to undergo public integrity training, right after he dismisses this case. 

We agreed that  Judge Thompson has forgotten he has a life time appointment and there is nothing they can do to him. However, they all draw their salaries from the same pot of money – the government.

The trial begins on Monday morning.

Please pray for each person involved in this case. Please pray for honesty in this case. Please pray a special prayer for me for the heat I will receive in my addressing this issue so frankly.

NOTE:  Personal matters of the persons involved are normally off limits in cases. The reason it is highlighted in this matter, the personal matters tie to the questionable activites of some of the the Public Integrity players of this case. Other than the attorney involved, the family members names are off limits in this and every case.

 This case is not about public corruption. This case is about persons with certian agendas having the right connections. Thanks be to Senator Scott Beason being stupid and not turning the tape recorder off.
