DOTHAN:     The following article is the reason the Dothan City Commission keeps Freddie Len White and Joe Herring in the Legal Department with the City of Dothan.


You see, when there is dirty, dishonest and deceitful work to be performed you need someone to  handle that dishonesty for you. Then as politicians you claim you have no control, that the person works for the City Manager.


And that is the claim of Dothan Commissioners, and the claim of John Ferguson and Beth "Yapper" Kenward, there is nothing they can do with the City Attorney without the recommendation of the City Manager. I call BULL MANURE!


For clarification, Ferguson and Kenward were not on the Commission when the following incident occurred.


But they are fully aware of the inadequate representation these two are giving the City of Dothan and they, along with the other Commissioners, continue to let it happen.

EMPLOYEE’S OF THE CITY OF DOTHAN


THIS COULD BE YOU!



A white male was hired by the City of Dothan in 1986 or 1987. He later transferred to another department in 1988.


The years 1989, 1990, 1991, 1992, 1993,1994 this employee was given "Commendable" and "Distinguished" evaluations.


Then he and his supervisor began to have problems. The employee went to the doctor and told the doctor "the City of Dothan was out to get him". The issue consumed him.


The employee’s mental stability was going down hill and he was having difficulties coping with the stress of the supervisor’s and department head of the City of Dothan always after him.


Then what the employee feared came true.


On November 1, 1994 the department head moved for a determination hearing to fire the employee. He had statements from co-employees that saw the employee performing work when, according to the department head, he was suppose to be at work. One of those department head puppets is currently a Dothan Department Head. BEWARE EMPLOYEES!


The employee was ordered in for a "determination hearing". The Assistant Personnel Director, a court reporter and others were present. The department head read the charges and the employee’s attorney asked could they respond by the end of the day in writing.


Permission was given to file a written response.


And the response was merely, department head, if you would get off your buttocks and check the work schedule, the employee was off the day in question, scheduled to work the next day, and did work the next day.


So with egg on the department heads face and his sheepdogs faces, the determination hearing was dismissed and the employee continued to work.


Things rocked on. The employee was mentally consumed with the "Big Boy City of Dothan Government" after him. He was being continually harassed at work. Which the harassment was ordained and supported by the department head.


Then his supervisor obtained arrest warrants for the employee for harassment. The case was dismissed because the warrant was obtained on comments made to a third party and not to the supervsior.


The department head was forced to retire. The department head had made awful decisions and is the only department head with the City of Dothan ever held accountable. He was not fired but allowed to retire.


And the City Manager ( not current ) took over as the department head.


The employee had let this issue, the power, the unethical conduct, the deceitfulness of the City of Dothan continue to consume him mentally. Even though the department head was gone, the supervisor and sheep dogs continued their quest against the employee. And the employee could not let it go and caused his own pain and suffering.


With City Manager Jerry Gwaltney as the Acting Department Head, Gwaltney terminated the employee.


AND THIS IS WHERE PROOF OF FREDDIE LEN WHITE


PERFORMED UNETHICAL, DECEITFUL AND FALSE STATEMENTS TO THE COURT


The employee was represented by Attorney Jim Parkman. There was a Personnel Board Hearing on the issues Gwaltney used to terminate the employee.


The Dothan Personnel Board is useless. They have never held a department head’s feet to the fire and always side with the department head. And this case was no different.


The employee appealed the termination to the Houston County Circuit Court, Case Number CV 96-5013.


Here is what Len White and The City of Dothan did...


12/11/1996    Circuit Court Judge Lawson Little:  Motion to withdraw granted and Hon. James W. Parkman III is allowed to withdraw as counsel ofr appelant - Deft. has 30 days to secure an atorney.


12/31/1996    In the Probate Court of Houston County, Dothan City Attorney filed a PETITION FOR INVOLUNTARY COMMITTMENT of the "former and terminated" Dothan City Employee, stating that the employee is mentally ill. 


12/31/1996    Houston County Probate Judge Luke Cooley issued a order based on Freddie Len White’s PETITION FOR INVOLUNTARY COMMITTMENT and ordered the Houston County Sheriff to take the "former and terminated" Dothan City employee into custody and place him in the Behavioral Medicine Unit at SAMC. Judge Cooley set a hearing on the matter for January 7, 1997.


1/6/1997      Attorney Alan C. Livingston of Lee and McInish was representing the City of Dothan in the court case of the former Dothan City Employee, where he appealed his termination and wanted his job back or a medical retirement. Livingston sent a letter to Dothan’s Personnel Director Jim Owen, and copied the letter to Len White, notifying the City of Dothan that Judge Little order the former terminated employee to get a new lawyer in 30 days. Attorney Alan Livingston, representing the City of Dothan, stated in the letter that if the employee did not secure an attorney by Febrary 11, 1997 " we will file a Motion To Dismiss".


1/7/1997     Houston County Probate Judge Luke Cooley, based on the petition filed by Dothan City Attorney Len White, order the "former and terminated" Dothan City employee ORDER FOR INPATIENT COMMITMENT, which ordered the former employee to Searcy Mental Hospital. The order was for a period "not to exceed" 150 days.


1/7/1997    The Houston County Sheriff Department, by order of Houston County Probate Judge Luke Cooley, transported the "former and terminated" Dothan City Employee in a Sheriff Patrol car locked behind the cage to Searcy Mental Hospital near Mobile Alabama.


2/24/1007   Attorney Alan C. Livingston of Lee and McInish, representing the City of Dothan, filed a Motion To Dismiss. In the motion Livingston stated to Judge Little " Since December 11, 1996 Appellant has failed to obtain counsel or otherwise proceed in the case and this case is therfore due to be dismissed for want of prosecution".


2/25/1997   Circuit Judge Lawson Little entered the following order: "Defendant’s Motion To Dismiss granted - case dismissed with prejudice. Costs taxed to Plaintiff".


4/7//1997    A memorandum from DEPARTMENT OF MENTAL HEALTH and MENTAL RETARDATION, SEARCY HOSPITAL, notified Judge Cooley the "former and terminated" employee of the City of Dothan was discharged from Searcy Hospital on March 12, 1997.



SOME FACTS TO UNDERSTAND



DISMISSED WITH PREJUDICE - means you can not bring the case up again.


The City of Dothan, Len White, placed the "former and terminated" Dothan employee in the Behavioral Medicince Unit of SAMC. He then sought and obtained involuntary commitment into Searcy hospital. 


Then while the employee was Involuntary Commitment, the City of Dothan Attorney, copied to Len White, had the employee’s appeal dismissed for failure to hire an attorney.


HE COULD NOT HIRE A LAWYER WHILE IN SEARCY HOSPITAL.


Furthermore, Len White nor Alan Livingston ever notified Circuit Judge Lawson Little they filed and had the employee placed in Searcy Mental Hospital so he could not hire a lawyer.


So when the "former and terminated" employee was released he could no nothing in even fighting for a medical retirement.


SO NOW, HOPEFULLY YOU UNDERSTAND WHY THE 


DOTHAN COMMISSIONERS KEEP THEIR LEGAL DEPARTMENT

These are court documents. I did black out the employees name. The court case number is there. I have a complete filed of which I spent $ 100 for documents.


But this type of unethical behavior by the legal staff of the City of Dothan is why the members of the Dothan Commission keep Len White and Joe Herring.
