Recommended sentence 100 months.  Judge Thompson reduced to 80 months, 37 months remaining.

What was your main livelihood?  I was a real estate developer.  I ran the day to day operations.  It tanked in 06-07


We had already began to get ready to do construction on a Country Music destination point in Coffee County.  When market tanked we moved to Houston County due electronic to put  bingo legislation in Coffee County.  We deemed not feasible to pass legislation in Coffee County.  We started investigating where in Alabama they had a constitutional amendment to have electronic bingo.  We chose Coffee County.


Country Crossing is what we build in Houston County.  We had to obtain a bingo permit from Houston County Commission, which we were able to do that.  It was a loosing proposition for the first 5 – 7 years without electronic bingo.


It was a cooperative improvement agreement and there were 7 phases and phase 1 had to be completed before we could open up.  It was to be a entertainment destination.


I made multiple presentations.  A meeting was set up between me and County, city and other leaders in Houston Co to do a presentation at the Chamber.


I made presentations at the Houston Co Comm meetings.  I went 2 or 3 times.

Mr Snellgrove approached me after the meeting and shook my hand and we congratulated each other and he stated he would like to talk with me in private after the media dispersed.  We met at my vehicle and rode around and talked.  What did you do after he approached you?  I agreed to meet with him.  I stuck around but it was normal for me to stick around and meet and greet.  Media had left


After small talk Mr. Snellgrove said he was considering getting into the security business with his boys and stated he wanted the security work at Country Crossings.  I told him he could submit a bid.  He told me I did not understand that they want the contract.  He said he could make it very difficult for me (Gilley) if they did not get the contract. 


Did you have a need?  We did need security, lots of people, lots of money, prior to opening we needed security to provide construction security.


I asked him to get a contract to Mark Sheldon,COO in my business.  HE said he did not want to do a contract, just invoice for services. 


Did you or anyone with Country Crossing execute a contract with Mr. Snellgrove or any other members of the Snellgrove family?  We never received a contract from Mr. Snellgrove.


What did you do at the end of the conversation.  I took him back to the parking lot and we parted ways.  I contacted Mark Sheldon and let him know he would be receiving paperwork.  At that time I thought they had a organized security business.


Were you ever aware of anyone going out there related with the security business?  Boyd Clark and Alan Clark with DSI had a contract for security during construction. 


A week or two after our initial meeting Mr. Snellgrove called me and said that he was aware that we needed security on sit during construction.  I told him we already had DSI.  Mr. Snellgrove told me at that time in no uncertain terms that he wanted that contract.  I cancelled DSI and gave to Mr. Snellgrove.


Gilley said that to his knowledge he never had a conversation with Mark Snellgrove, he might have met him at Bama Jam once.


Mr. Bobby Snellgrove faxed in invoices and we paid them. 


Ronnie Gilley Properties was the holding company for all of the companies.  I was chairman.


Lisenby is going over the multiple companies that were connected to Gilley.


Did you ever become aware that there were some issues with the security services?  I did, I received complaints constantly and the project was not secured.  The front gate was open, unsecured.  I went out one night that there was no security on the site at all.  I found out later that they were at the cabin in the woods.  My construction supt. went down there and found them.  I let Mr. Snellgrove know what was going on, he told me he would remedy it and it was never remedied.  I had no choice but to continue to pay Mr. Snellgrove because he let me know in no uncertain terms that there would be problems if I did not.


Were there other things going on before the Houston County Commission itself?  We proposed that the bingo regulations be amended.

Mark created a parking lot security detail to continue paying them. 


We did not stop paying until a few months after we were forced to close.  We were forced to close in January 2010.

What does the first page show?  Print out of checks paid  to Regional Services $167.284. 80.  Last check March 5, 2010 paid to Regional Services.  2nd page is a continuation from first page.  First date March 19, 2010,  last one Oct. 1, 2010.


$214,000+ was paid to Regional Services by Resorts Development Group 2.


Last entries say “Manual Reversal” what does that mean?  I am not a accountant and I can’t see.  Mark Sheldon can probably tell you that.


Invoice Date is August 6, 2010, Vendor Regional Services.  Comment says Guard Services at Country Crossing 7-2-10 through 7-15-2010.  Was Country Crossings open and operating at that time?  No sir.  Why were you paying them then?  Because we felt we had to have the services and we were hoping we would reopen..  We already had a governor creating havoc and we did not feel we needed a county commissioner giving us trouble. 


Did you have a events at Country Crossings as you were constructing Country Crossings?  We did..Ronnie Gilley Entertainment.  Bills paid from Resorts Development Group 2. 


Snellgrove contacted me and he said he was thinking about getting in the port-a-john business.  I did not want to get into any more business with Mr. Snellgrove so I told him to contact Mark. 


We did need additional restroom facilities.  When we had the concerts we needed more facilities for the crowd.  The stars requested executive port-a-johns.  Also for the construction site.  We had someone from Enterprise that had the contract.


Mr. Snellgrove called me and went off on me because he drove through the project and noticed that we had port-a-johns all over the site and he informed me that he had invested in port-a-johns for Country Crossings.  He told me in no uncertain terms that I could get rid of Ashton and use his company or that he will see that our grand opening is short lived. 


I called Mark and told him that if the governor did not close us that a county commissioner might be closing us down.   Mark called Mr. Snellgrove and told him he could put them out there.  Ashton removed his.  Mr. Snellgrove only had basic port-a-johns.  The stars contract calls for executive bathrooms what have nice dressing rooms in them.  Snellgrove did not carry the executive restrooms.  We had to leave the executive restrooms Ashton Parrish provided.


WE had one more event after we were closed down.  Mr. Snellgrove’s port-a-johns were used there. 


Gilley is looking at another vendor reports where Celebrity Station LLC paid Regional Portables LLC $6,000+


The check history report is on the screen where they paid Regional Portables, LLC.

Resorts Development Group 2 paid  $1,551,516 to Houston County Commission for tax stamps for electronic bingo machines.  We paid a year in advance.  We were closed down In January and we requested a refund from the Houston County Commission.  Mr. Snellgrove voted against the refund.  The commission decided to let a judge decide if it was legal for them to make the refund.  A motion was made to let the judge decide and it passed by all yes votes.


We were given a prorated amount. We paid for the stamps for the time we were actually opened and probably a few days after that. 


Do you know why he voted no on this particular resolution?  I do because we quit paying him. He was the only one that voted no.


Sheffield:


I saw you throw your paper down, it made you mad didn’t you that you had to pay all of those attorneys.


Let’s go back to the date you talked Snellgrove.  How did you have equipment on the property when you did not have a contract to purpose.  How can you have equipment on the ground in two locations when you only have a security contract to purchase. 


Feb 25, 2008  I have a Dothan Eagle article from March 4, 2008…Title says Gilley on verge of Country Crossing Land Purchase.  That is the artifact land wasn’t it?  Gilley is reading the article.  Gilley doesn’t see where it says which land it was…Sheffield says you narrowed it to two locations.  Lisenby objecting to using a newspaper article.  Judge Mendheim calls lawyers to bench. 


On March 4, 2008 you had narrowed it to two articles.  I am not going to agree to anything published by the Dothan Eagle. 


Several months later you backed out of the first land deal because of artifacts? Correct.  Then you bought the land from Keith Givens?  I did. 


Isn’t it true that if that had not been approved on February 25, 2008 this project would have been dead.  Yes.


2006 you talked about real estate went into tail spin?  Yes sir. 


April 25, 2012 you remember testifying that you went into bingo because it was like printing money.  What are you worth today? Negative 100 million


You are aware this case was originally supposed to go forth around Jan 12, 2015? Yes sir.


Weren’t you promised that the Attorney General would speak on your behalf to get your sentenced reduced.  I was told he would speak on my behalf not to get sentenced reduced.


Luther Strange letter was December 5, 2014.  Are you aware that a motion to continue this case was filed shortly after that?  No sir

What was the mood when you and your family were coming from Enterprise to Dothan?  I don’t know.  Was George with you on February 25 when y’all were coming down here to get your bingo legislation passed?  I don’t remember.  Your wife and your sons were with you?  I know my boys were not there.  You came by yourself to the biggest event in your life?  It was not the biggest event in my life.


The Houston County Comm starts at 10 am? I think so.  That meeting lasted a little longer than usual didn’t it?  I don’t remember.  Where did you park?  Behind the bbq.  Didn’t you see all of the press there.


Downtown Dothan, don’t you know that Rickey Stokes office is in downtown Dothan?  I don’t know where Rickey Stokes office is.  Don’t you know that there are lots of cameras around Dothan?  I don’t know.

The day the resolution was passed did you leave your wife at the probate office while you and Mr. Snellgrove rode around?  I don’t recall my wife being there when I got in the car with Mr. Snellgrove and rode around.  So you came to get your printing press going and you can’t remember if your wife came but you can remember all of these other details.


On Feb 25 you shut your phone off about 28 minutes before the commission meeting.  You said you were riding around with Mr. Bobby? I did.  How did you ride around  talking to him when your were on your cellphone all the time?  Gilley says he was always on the phone. 


There are no breaks in there are there?  Gilley says If you go through all of these pages it would be like that.  But there is not a break until after the time you say you rode around with Mr. Snellgrove?  You were talking to all of your supporters weren’t you.  There is around a 30 minute gap a 12:35 until the mother of my children called .


Do you recognize that number as Chairman Culver’s number?  It would not surprise me.  Mr. Culver called you while you were with Mr. Snellgrove.


Let’s count the calls, Mr. Snellgrove called you 6 times.  That would leave you calling him how many times.  Would you be surprised that you talked with Chairman Culver all during the night? 


Kelly Pickler concert got rained out?  It got rained out.  You had to move it to the Civic Center.  You called and talked to Chairman Culver and you moved it to the Civic Center. 


Oct 15 right before that,  That was an important week wasn’t it.  Wasn’t that when you started doing your big hiring?  Gilley: That is what that paper suggests. 


Wasn’t that about the time that Whitehall was raided?  I don’t remember that. 


November 13 Alabama Supreme Court sided with the Governor on taking the electronic machines.  Weren’t you talking to all the commissioners about that?  I don’t remember.  They were interested in if they have a legal operation weren’t they?  I imagine.


Grand Opening January 15 and 17, is that when you are saying Mr. Bobby approached you about the port-a-potties?  That was the grand opening.   The commodores were there and they needed the fancy potties didn’t they?  Yes.  Were there any phone calls between y’all on that date?  Not on that phone there were not.
