What Was Really The Vote In Ozark

OZARK:    These questions are beig posed to me in reference to the Ozark City Council. Therefore I will ask publically for the citizens of Ozark.


My phone has rung off the hook in reference to the vote for Ozark Police Chief. I was told by the lady that does the minutes that the vote was unanimous for Marlos Walker. While I have not spoke with the Mayor and Council members, people who I trust, said council members deny they voted for Walker. That is what prompted me to physically travel to Ozark and ask.


Through some sources that I respect very much, and through some text messages, the following information has been communicated to me:


(1) Ozark City Council went into Executive Session to discuss the candidates:  good name and character is a permissible issue to go into Executive Session. So that is permissible


HERE COMES THE ISSUE


(2) A vote or votes are reported to have taken place in the Executive Session:  that is against the law.


RSN is told from multiple sources, and Ozark City Council Members be careful how you publically answer, because, we are told as follows:


1. There was a vote taken as to Myron Williams, the first name mentioned in Executive Session. Williams served as Deputy Chief for Ozark Police. We are told the vote was 2 to 2 with Andy Gilland not voting. So that died because not a majority vote.


2. There was a vote taken as to Marlos Walker, the second name mentioned in Executive Session. The vote was 2 to 2. Reports are Andy Gilland then broke the tie for Marlos Walker.


We are told it was a heated exchange in the debate. Which the debate, according to the Alabama Open Meetings Law is LEGALLY to be done in public. Only the narrow issues of good name and character are to be discussed in an Executive Session. In fact, Alabama Law calls for up to a $ 1,000.00 fine individually for each member who participated in the illegal executive session. And the City can not pay the fine, INDIVIDUALLY each member can be fined up to $ 1,000.00


Then we are told the Ozark City Council came out of the Executive Session and made a symbolic, we are all together vote. But this was done early in the morning to limit the persons in attendance.


Now Ozark City Council Members are reported to be telling people "oh I did not vote for him". 


Word from withing Ozark Police Department, is they were told it was a 3 to 2 vote.


NOW, I have asked the question. The citizens of Ozark need to put your elected officials ON THE SPOT and see if you have elected officials who will tell the truth. And elected officials telling the truth, well that is rare!
