EUFAULA:       This report is UNCONFIRMED by law enforcement but arrived at RSN via TEXT RICKEY 334-790-1729.


Reports are this morning on Clayton Highway there was a home invasion. The couple was in bed when the reported intruders entered the house.


The husband is reported to have been able to take a weapon, reported a shotgun, from the intruder during the struggle. The husband was successful in obtaining the shotgun.


The intruder’s brain told the feet, it is now time to RUN!!!


The intruder ran but the husband was able to fire some shots off towards the intruder as he fled.


Fortunately the intruder was not struck. Why fortunately? Because if someone is running away from you then you can not shoot them. If the home owner had struck the intruder there is a possibility the home owner could be charged.


But if the intruder was still inside and they could articulate their lives were still in danger, then by all means shoot until the threat is no longer a threat.


Not giving legal advice but as it has been explained to me!


You can only use deadly physical force if you or someone else life is in danger of serious bodily injury or death. With the intruder running away that element would possibly not exist.


Unfortunately, if the facts are accurate as reported to RSN, the intruder made it to run rather be in a position the home owner would have been in a justified position to have used deadly physical force.


WHY DO I EXPLAIN THIS?  Not saying the Barbour County District Attorney would have brought charges, but there are many zealous District Attorney’s who are crazy. Look at all they are going to just to destroy Donald Trump.


And, in my opinion, the Circuit Court Judge Bert Smithart in Barbour and Bullock County, well he is someone who is a nut And in my opinion not honest. AGAIN - My opinion.


So I would not want any homeowner or someone to get caught in the heat of the moment and end up in trouble,
