THIS IS A SMART BUTT QUESTION, BUT...
If you hunt deer out of season, the Alabama Game Warden is going to give you a citation.
If you bait deer, the Alabama Game Warden is going to give you a citation.
If you hunt deer at night, the Alabama Game Warden is going to arrest you, seize your guns and vehicle, and make you pay thousands of dollars.
When prosecuted the case is styled in court, STATE OF ALABAMA verses John Doe.
So if the State claims the deer is property of the state, why can there not be a legal action against the State of Alabama for the damages the deer caused to your vehicle?
The State of Alabama failed to exercise control over their property, of which they will put you in jail and take what you have, if you violate the laws in order to hunt them.
Remember, a lady filed a lawsuit against McDonald's because their coffee was to hot.
