HOUSTON COUNTY - DOTHAN:        Retired 20th Judicial Circuit Court Judge Larry Anderson returned to the bench this past week.


Judge Larry Anderson retired January 17 as a 25 plus year serving Circuit Judge for Houston and Henry County. Anderson did not seek re-election and Chris Richardson was sworn in as the new Circuit Judge.


judge Larry Anderson returned for a week of criminal jury trial of municipal cases appealed from Dothan Municipal Court to Circuit Court for the 20th Judicial Circuit.


A Municipal Court is a court of “no record”. That is there is no court reporter. The maximum sentence which can be given by a Municipal Judge is 12 months and everything done in Municipal Court can be appealed to Circuit Court.


The appeal is called a trial de novo, which as explained to me is defined as “begin again”. No matter what the Municipal Court did the case begins fresh and new and instead of in front of a Judge only the case is before a jury of 12. There is a court reporter in the Circuit Court case and a record if the defendant feels that case needs to be appealed to the upper courts.


The City of Dothan attorney’s office is the prosecutors and they prosecute the appeals heard in Circuit Court.


There is a tremendous backlog of Municipal Appeals pending. Some back to 2015.


The City of Dothan has no full time City Attorney. A long time serving Assistant City Attorney, Kevin Kelly, is Interim City Attorney which is managing all legal issues for the City of Dothan. And according to sources within the Houston County Courthouse Assistant City Attorney - Interim City Attorney Kevin Kelly did an outstanding job in clearing the docket of appeals before Judge Larry Anderson.


It is not clear why the leadership of Dothan did not appoint Kevin Kelly as City Attorney. But apparently he is capable enough to be Interim City Attorney. Perhaps he is to honest of a person to be City Attorney for the dirty tricks the leadership likes to have their attorney do for them.


Retired City Attorney Len White did some shady manure for the the so called leadership of the City of Dothan, in my opinion. Kelly is honest, a feature the City of Dothan does not like in a candidate for City Attorney.


Prior to becoming Circuit Judge, Larry Anderson served as Attorney for the City of Dothan under then Dothan Mayors Larry Register and Alfred Saliba. Anderson left the City of Dothan and unsuccessfully ran against Denny Holloway for 20th Judicial Circuit Court Judge. Later a new judgeship was created by then Govenor Fob James and Larry Anderson was appointed to serve.
