Alabama Department of Labor Obtaining Convictions for Unemployment Compensation Fraud

MONTGOMERY – Alabama Department of Labor Secretary Fitzgerald Washington announced today that the Department has successfully prosecuted several Alabamians for unemployment compensation fraud.  The following individuals were charged with a violation of the Alabama Unemployment Compensation Law by making false statements in claims for benefits:


 



  • Dominic D. Gipson, of Boligee, was tried in Greene County Circuit Court on June 6, 2019.  An investigation by Labor’s Benefit Payment Control Section determined that Gipson received a total of $7,468 in benefits to which he was not entitled.


 


Gipson pled guilty to theft of property, 4th degree, and was sentenced to one year in jail, which was suspended, and two years of unsupervised probation. He was ordered to pay restitution in the amount of benefits received illegally.


 



  • Timothy P. Bell, of Greensboro, was tried in Hale County District Court on July 11, 2019.  An investigation by Labor’s Benefit Payment Control Section determined that Bell received a total of $2,487 in benefits to which he was not entitled.


 


Bell pled guilty to an amended misdemeanor fraud charge and was sentenced to 90 days in jail, which was suspended, and given two years of unsupervised probation. He was also ordered to pay a victim’s assessment fee, court costs, and restitution in the amount of benefits received illegally.


 



  • Mondarius Pollard, of Shorter, was tried in Macon County Circuit Court on April 30, 2019.  An investigation by Labor’s Benefit Payment Control Section determined that Pollard received a total of $3,063 in benefits to which he was not entitled.


 


Pollard was placed into the pre-trial diversion program and was sentenced to 24 months of supervised probation.  He was also ordered to pay a victim’s assessment fee and restitution in the amount of benefits received illegally.


 



  • Antonio Gideon, of Madison, was tried in Madison County Circuit Court on July 24, 2019.  An investigation by Labor’s Benefit Payment Control Section determined that Gideon received a total of $1,623 in benefits to which he was not entitled.


 


Gideon pled guilty to an amended theft of property 4th degree charge and was sentenced to one year in jail, which was suspended for two years, and given two years of unsupervised probation. He was also ordered to pay a victim’s assessment fee, court costs, and restitution in the amount of benefits received illegally.


 



  • Marcus Nelson, of Talladega, was tried in Talladega County District Court on June 6, 2019.  An investigation by Labor’s Benefit Payment Control Section determined that Nelson received a total of $2,321 in benefits to which he was not entitled.


 


Nelson pled guilty and was sentenced to one year in jail, which was suspended, and given one year of probation. He was also ordered to pay restitution in the amount of benefits received illegally.


 



  • Keithen W. Kinnie, of Tuscaloosa, was tried in Tuscaloosa County District Court on July 25, 2019.  An investigation by Labor’s Benefit Payment Control Section determined that Kinnie received a total of $1,844 in benefits to which he was not entitled.


 


Kinnie pled guilty and was sentenced to one year in jail, which was suspended for two years, and given two years of probation. He was also ordered to pay restitution in the amount of benefits received illegally.


 


 


The following individuals were charged with Theft of Property, First Degree:


 



  • Richard Lamb, of Birmingham, was tried in Jefferson County Circuit Court on June 27, 2019.  An investigation by Labor’s Benefit Payment Control Section determined that Lamb received a total of $12,640 in benefits to which he was not entitled.


 


Lamb pled guilty to theft by deception, and was sentenced to 30 months in jail.  He was also ordered to pay court costs, and restitution in the amount of benefits received illegally.


 



  • Patrick D. Stearns, of Sylacauga, was tried in Talladega County Circuit Court on May 8, 2019.  An investigation by Labor’s Benefit Payment Control Section determined that Stearns received a total of $13,863 in benefits to which he was not entitled.


 


Stearns pled guilty and was sentenced to 36 months in jail, which was suspended, and given three years of unsupervised probation He was also ordered to pay a victim’s assessment fee, court costs and restitution in the amount of benefits received illegally.


 



  • Jerry Austin, of Eight Mile, was tried in Mobile County Circuit Court on June 27, 2019.  An investigation by Labor’s Benefit Payment Control Section determined that Austin received a total of $5,830 in benefits to which he was not entitled.


 


Austin pled guilty to an amended charge of Theft of Property, 4th Degree, and was sentenced to one year in jail, which was suspended for two years, and given two years of supervised probation.  He was also ordered to pay a victim’s assessment fee and restitution in the amount of benefits received illegally.


 



  • Tony M. Jones, of Mobile, was tried in Mobile County Circuit Court on August 19, 2019.  An investigation by Labor’s Benefit Payment Control Section determined that Jones received a total of $2,947 in benefits to which he was not entitled.


 


Jones pled guilty to an amended charge of Theft of Property, 4th Degree, and was sentenced to one year in jail, which was suspended for one year, and given one year of unsupervised probation.  He was also ordered to pay a victim’s assessment fee and restitution in the amount of benefits received illegally.



  • Jennifer K. Bell, of Jacksonville, was tried in Morgan County Circuit Court on June 27, 2019.  An investigation by Labor’s Benefit Payment Control Section determined that
