Capital Murder Suspect Has Bonds Set - Self Defense Probable Cause Established

DOTHAN:    A recent arrest of 31 year old Carmen Kirkland for Capital Murder. A shooting death where 33 year old Precious Warren was murdered.


The family and friends of Carmen Kirkland hired Dothan Attorney Shaun McGhee and Derek Yarbrough to represent Ms. Kirkland.


This past Friday Attorneys Shaun McGhee and Derek Yarbrough held a preliminary hearing in Houston County District Court for their client Carmen Kirkland. During the course of the preliminary hearing, which is a probable cause hearing, the attorneys admitted to Kirkland shooting Warren but presented evidence where they felt it was self defense.


Attorneys McGhee and Yarbrough presented evidence of an on going dispute between Kirkland and Warren. Evidence was presented where Warren attacked Kirkland multiple times. Evidence was also presented where Warren pepper sprayed Kirkland and Kirklamnd's three children.


Evidence was also presented by Attorneys McGhee and Yarbrough of numberous police reports filed by Kirkland on Warren. Kirkland made allegations of Warren posing a danger to Kirkland. At the time of the shooting there were outstanding arrest warrants on Warren.


On Monday, following the preliminary hearing, Houston County District Court set bond on the Captial Murder charge at $ 150,000.00, each, for the two Capital Murder charges.


The cases have been bound over to a Grand Jury.


A preliminary hearing works both ways. While the hearing established probable cause a crime was committed, it also establishes probable cause of the self defense.


Normally no bonds for Capital Murder. When attorneys present evidence, as McGhee and Yarbrough did, of probable cause of self defense, a Judge is proper not to leave that person sitting in the Houston County Jail for two or more years awaiting trial.


Kirkland made bond today and released from the Houston County Jail.
