Did Ozark Mayor and City Council Violate Alabama Law

OZARK:     The accusations from Ozark Mayor Mark Blakenship and members of the Ozark City Council against Ozark Police Chief Marlos Walker and Ozark Police Major Tim Hicks.


Those accusations were described as violation of policy and procedure and not violations of Alabama Law.


We have scanned Alabama Law on Open Meetings.


Refer to page(s) 23 - 26, WHAT ARE GROUNDS FOR EXECUTIVE SESSION? 


Specifically refer to page 25, "However, the job performance of the following persons cannot be discussed in an executive session; (A) ANY elected or appointed public official (B) Any appointed member of a state or local board or commission (C) A public employee required to file a Statement of Economic Interests with the Alabama Ethics Commission under Alabama Code 36-25-14.


Refer to page 26 "there are no circumstances under which job performance of public officials can be discussed in executive sessions".

Mayor Blakenship made it clear the Chief of Police serves at the pleasure of the Ozark City Council. Therefore it is clear the Chief of Police is "appointed". It is clear that the Chief of Police is a "public official".


QUESTION:   Ozark Police Chief Marlos Walker and Ozark Police Major were fired for violating policy. So if Ozark Mayor Mark Blakenship violated Alabama law in the Executive Session, will the Ozark Mayor and Ozark City Council members then resign?


Or ... are there double standards for the City of Ozark?
