OZARK: The Animal Cruelty cases against Ozark Veterinarian Dr. Richard Timothy Logan were scheduled today before Ozark Municipal Court Judge Stegall.
The defense attorney for Dr. Logan is David Harrison of Geneva.
Defense Attorney David Harrison filed a motion with the court for another Judge rather than Judge Steagall. That motion is taken under advisement and the Judge has not ruled on the defense motion.
The case can not go forward until which time the Judge rules on the motion. No date has been set for trial until the Judge rules on the motion.
There was public outrage after a video surfaced where is depicted what appeared to be Dr. Logan mistreating the animals. Once the video surfaced and public outrage Ozark Police conducted an investigation. Dr. Logan was later arrested on two counts of animal cruelty.
This case is in Ozark Municipal Court. This case is at Ozark City Hall and not Dale County District Court. Should Ozark Municipal Court find Dr. Logan guilty the doctor would have 14 days from the municipal court verdict to appeal to Dale County Circuit Court.
Trials appealed from Municipal Court or District Court are appealed directly to Circuit Court. A Municipal Court or District Court are what is called a “court of no record”, which means there are no court reporters and transcripts of the trial.
When appealed from Municipal Court of District Court, it is called a trial de novo which means “ from the beginning “. The case would then begin from scratch as if the Municipal Court or District Court trial never occurred.
