GENEVA:   Johnson Controls, as we understand is Reliable in Geneva, issued a directive to all employees today.


Coming from the SR HR Generalist, Lynntesha ( Lynn ) Henley, the email was addressed to a number of people but titled VOLUNTEER FIRE & RESCUE PROGRAM - SUSPENSION. 


Ms. Henley, if the same one I found on Facebook, resides in Dothan. The directive reads "Effective immediately the Volunteer Fire & Rescue Program is SUSPEND until further notice. We do understand the importance of this program to the local community however until rules and regulations are put into place to ensure accountability and a productive work environment here at JCI, any departure to participate must be approved by your supervisor and will be considered an unpaid occurrence." 



A lot of the volunteer members of Geneva Fire and Geneva Rescue are employees of Johnson Controls, in Geneva as we understand Reliable. The memorandum was dated November 8, 2019, and some 4 days later the temperature is 32 degrees.


The chances are greater for a structure fire now with the weather change from warm to cold. Yesterday it was like in the 60 to 70 degree range and tonight the temperature is 32 degrees when I checked time and temperature at 9:00 PM.


This is serious business to the health, safety and welfare of the people of Geneva and the surrounding area. And mental trauma to the men and women who work there because when they hear their fellow community members in danger and they can not respond it works on them mentally.


If Lynntesha ( Lynn ) Henley that I found on FACEBOOK that resides in Dothan, her health, welfare and safety are by a paid fire department which operates with 175 full time employees and a $ 14 million dollar budget. The workforce that her Directive is sent to, their community is protected by those who risk their lives, health and welfare to save their neighbors in the community. 


Also Henley's Directive is contrary the Johnson Controls definitions below on their web site. Their fire supression section of the web site reads "HELPING SAVE LIVES AND PROTECT PROPERTY" but Ms. Henley does as most do, especially Corporate America, we do not care!!! 


The fireman and women, the EMS men and women now must make a choice, leave and save lives and property or continue to work with tears flowing down their cheeks so they will not loose a paycheck in order to continue to feed their own family and keep their homes.


And I have been very surprised at how many people believe the same as Ms. Henley and Johnson Controls. They speak one way but their actions are totally different. They really do not care or understand and had rather not fix the problems to save lives and property, just complain about those who do care about lives and property and devote their time and energies, risk their own life, to save lives and property.


If your loved one dies because no one to respond to the medical emergency, if your child dies because no one to respond to the medical emergency, if your home burns because no one to respond to the fire, I will confirm the Lynntesha ( Lynn ) Henley I found on FACEBOOK ( and the picture is saved ) post the picture so you will know who it is that has prevented the employee from responding.


And I promise you that employee who has served with fire and EMS, will have tears flowing down their cheeks knowing they can help but their family must eat while yours dies.

CODE OF ALABAMA 36-21-160


(a) As used in this section, the following terms shall have the following meanings:



(1) EMERGENCY.  Going to, attending to, or coming from any of the following:



a. A fire call.




b. A hazardous or toxic materials spill and cleanup.




c. Any other situation to which a volunteer fire department has been dispatched.




d. An actual medical emergency to prevent the imminent loss of life.





(2) EMPLOYER.  Any individual, partnership, association, corporation, business trust, or any person or group of persons acting directly or indirectly in the interest of an employer in relation to any employee.




(3) VOLUNTEER EMERGENCY WORKER.  An individual who does not receive monetary compensation for his or her service as a volunteer firefighter, emergency medical technician, rescue squad member, volunteer deputy, or a ham radio operator conducting storm spotter operations for an emergency management association.




(b) No employer may terminate an employee who is a member of a volunteer fire department and who, in the line of emergency duty as a volunteer firefighter, responds to an emergency call prior to the time the employee is due to report to work and which emergency results in a loss of time from employment.  Any time lost from employment as provided in this section may be charged against the regular compensation of the employee.  Prior to missing work, the employee shall attempt to contact his or her employer to notify the employer that the employee has been dispatched to an emergency.  At the request of the employer, an employee losing time as provided herein shall supply the employer with a statement from the chief of the volunteer fire department stating that the employee responded to an emergency call and the time thereof.




(c) No employer may terminate an employee who is a member of an emergency medical service and who, in the line of emergency duty as an emergency medical service member, responds to an emergency call prior to the time the employee is due to report to work and which emergency results in a loss of time from employment.  Any time lost from employment as provided in this section may be charged against the regular compensation of the employee.  At the request of the employer, an employee losing time as provided herein shall supply the employer with a statement from the fire department or emergency medical services stating that the employee responded to an emergency call and the time thereof.




(d) Any employer who willfully and knowingly violates this section shall be required to reinstate the employee to the employee's former position and shall be required to pay such employee all lost wages and benefits for the period between termination and reinstatement.




(e) Any action to enforce this section shall be commenced within a period of one year after the date of violation and such action shall be commenced in the circuit court of the county in which the place of employment is located.




(f) Nothing in this section shall prohibit an employer from terminating an employee covered in this section for lawful reasons other than responding to an emergency call that results in loss of time from employment.
