MONTGOMERY:    They can suck the money from the money paid into the State of Alabama but they can not confirm or deny if an active case is pending before a sitting Judge in the State of Alabama.

We have learned that a sitting District Court Judge is possibly under investigation by the Alabama Judicial Inquiry Commission.

RSN called the Alabama Judicial Inquiry Commission and asked. They said a complaint can be confirmed or denied. A hearing can not be confirmed or denied.

Then I asked them who pays the Judicial Inquiry Commission to operate? If paid by the public why can you not answer if there is a pending hearing?

Then they repeated their programmed statement that they can not confirm or deny a complaint has been filed.

So to find out specifics I guess we are just going to have to sit back and sip on our coffee until which time we have confirmation of the complaint, investigation, hearing and results.

We have information that District Court Judge in a county west of Houston County ( not Dale or Geneva County, Houston or Henry County ) is or has been investigated by the Alabama Judicial Inquiry Commission. Based on the investigation it is the information provided to RSN that the District County Judge is being given time to resign. But sources say that he is not going to resign.

According to the Alabama Judicial Inquiry Commission web site their stated purpose is:

Judicial Inquiry Commission

The Alabama Supreme Court formulated, established, and, on December 15, 1975, adopted the Alabama Canons of Judicial Ethics "as a code for judges and a declaration of that which the people of the State of Alabama have a right to expect of them." Preamble, Alabama Canons of Judicial Ethics.

Alabama, like each of the 49 other states and the District of Columbia, has a judicial-conduct system that is the primary means by which ethical standards for and other conduct of judges are regulated. These judicial-conduct systems were instituted to ensure the integrity, independence, and impartiality of judges and the judicial system by

  • enforcing standards of judicial conduct on and off the bench;

  • assisting the judiciary in maintaining the necessary balance between independence and accountability;

  • providing an accessible forum for citizens’ complaints against judges;

  • creating a greater public awareness of what constitutes proper and improper judicial conduct; and

  • protecting judges from false, unfounded, and inaccurate accusations.
