McCraney Seeks New Trial

Coley McCraney, the man convicted in April of the 1999 murders of teens JB Beasley and Tracie Hawlett, is seeking a new trial after being sentenced to life in prison without the possibility of parole.
He and his attorneys, David Harrison and Andrew Scarborough, had thirty days to appeal.
The attorneys filed a petition this week; the motion alleges juror misconduct and improper court proceedings.
The attorneys claim that three jurors posted to social media during the trial and claim one was even posting while deliberations were taking place. They also say another juror was scrolling though a technical device. Both of these are rulebreakers for the trial according to the rules set forth for the jury at the beginning of the trial that were read to them by Dale County District Judge William Filmore.
According to Attorney Harrison, there was also a Brady Violation, which is when the state withholds certain evidence that would prove the innocence of the defendant.
In addition, they allege that Judge Filmore was incorrect when he said Harrison was trying to confuse the jury with remarks made during arguments that were objected by Alabama Attorney General Steve Marshall.
There will be a hearing on July 17 to decide whether or not McCraney will get a new trial.
