BLOUNT COUNTY AL:    This article is not an attempt to be critical of law enforcement. 


The law is interesting to me and legal issues are interesting to me.


This is a case where a male and female Blount County Alabama Deputies arrest an attorney and his assistant for representing their client.


The deputies watched the defendant, attorney and his assistant entering into the courthouse and their actions while in the courthouse. 


As the defendant, attorney and attorney assistant were leaving the Blount County Courthouse the male and female deputies stopped them. They offered a search warrant for the (1) person of the defendant (2) the vehicle of the defendant. They wanted to seize the defendant's phone.


The search warrant was presented to the defendant and the attorney. The defendant produced the keys to the vehicle. Then the deputies told the attorney they witnessed the defendant handing the attorney the cell phones while in the courthouse and he handed them to his assistant.


But the attorney told the deputies the search warrant only gives them the authority to search the defendant and his vehicle. The attorney told them it did not give the deputies the authority to search his assistants briefcase.


The deputies to the attorney and assistant they were being detained. Later the deputies arrested the attorney and his assistant for Obstructing Governmental Operations.


The search was dismissed and the attorney and his assistant were found not guilty. It has resulted in a federal lawsuit.


SEARCH WARRANTS - a law enforcement officer gets a search warrant and is searching for truck tires. That search warrant then does not allow the officer to open a dresser drawer. It is impossible to hide truck tires in the dresser. Therefore anything found in the drawer smaller than a car tire is not subject to seizure.
