HOUSTON COUNTY: Barbour - Bullock County Circuit Court Judge Burt Smithhart handed down the sentence to Mark Johnson.
Johnson is a former law enforcement officer that served in Houston County. Johnson then attended law school.
Following graduation of law school Johnson entered private practice for several years. Under the tenure of former 20th Judicial Circuit Court District Attorney Pat Jones Johnson served as an Assistant District Attorney.
Complaints were made against Johnson by defendants. Those complaints were forwarded to the Alabama Attorney General Office. When the complaints were turned over to the Alabama Attorney General Office then District Attorney Pat Jones placed Johnson on Administrative Leave.
A investigation resulted and the case was presented to a 20th Judicial Circuit Grand Jury in Houston County. Indictments were returned. At that time Jones then terminated Johnson employment.
Judge Smithhart sentenced Johnson to 120 months in Community Corrections. In the sentence Johnson was ordered to serve 30 months in house followed by 3.5 years probation.
There are only three counties in Alabama which have Community Corrections Program where people stay in overnight. Those programs are in Houston County, Lauderdale County and Madison County. Johnson would be required to turn himself into Houston County and then be transferred to Lauderdale County or Madison County.
While Johnson has not prosecuted in 2.5 years, some people he has prosecuted are serving time in the Houston County Community Corrections Program.
Judge Smithhart set a $ 60,000.00 appeal bond in his case. The appeal bond was made by A - Advantage Bonding and Johnson was released pending appeal.
Johnson is represented by Dustin Fowler and Stephen Etheredge of Buntin, Etheredge and Fowler Law Firm.
Mr. Mark Johnson The has never worked with the current District Attorney, Russ Goodson. These charges and indictments were lodged before Goodson was ever District Attorney for the 20th Judicial Circuit.
When indictments were returned then District Attorney Pat Jones terminated Johnson employment with the 20th Judicial Circuit District Attorney Office.
