HOUSTON COUNTY:    In a stunning legal outcome, former Houston County Assistant District Attorney Mark Johnson has avoided a prison sentence despite being convicted on six counts of ethics violations. Johnson, who faced up to 120 years in prison, will instead serve 30 months in a community corrections program, which will allow him to leave during the day to work. This rare and unexpected result is being attributed to the skilled defense team, Stephen Etheredge, Dustin Fowler and Jennifer Tompkins, whose legal strategy ultimately prevented a severe sentence.


Johnson, once a well-respected prosecutor in Houston County, was convicted of using his position to solicit sexual favors from female defendants. The charges included allegations that Johnson used his influence to obtain sexual photographs and inappropriate communications with women who were facing criminal charges. These interactions, according to testimony presented at trial, included offers of preferential treatment in exchange for sexual favors. The prosecution, led by the Alabama Attorney General’s Office, painted a damning picture of Johnson’s actions, claiming that he habitually abused his power to exploit vulnerable women.


Despite the convictions, Johnson’s defense team, successfully argued that the prosecution’s case lacked concrete evidence of preferential treatment in exchange for favors, a critical element in proving the ethics violations. The leniency of Johnson’s sentence has shocked many in the legal community, given that Alabama’s Attorney General’s Special Prosecutions Division, an elite public corruption unit, was responsible for the prosecution.
