Houston County School Supt. Brandy White Could Be Leading Board Into A Lawsuit

HOUSTON COUNTY:    Houston County School Superintendent Brandy White took over the reigns as Superintendent on January 1, 2021. Tonight White and the members of the School Board were met with a house full of Houston County High School parents.

Over the past month Brandy White has been flooded with calls, letter and emails. According to sources within the bowels of the school system White wanted them to stop. He was tired of hearing from those who elected him.

The controversy stems from the March 19, 2021 actions of Superintendent Brandy White placing Teacher Daphne Hamm on Administrative Leave. This was done during school in front of the students and faculty at Houston County High School. Superintendent White instructed Ms. Hamm to "you will retrieve the necessary supporting documentation showing that the dog is a service dog is in fact a service dog. Also, administrative leave will allow time to investigate your various acts of insubordination, incompetency, and/or neglect of duty." White said when the investigation is complete that he would contact Ms. Hamm and "schedule a time to review any of the the requested supporting documentation before rendering a decision".

Tonight on WDHN Superintendent White stated that Hamm was not placed on 10 days suspension for the animal but for the other things brought out in the investigation. (1) Insubordinate in White states he asked Ms. Hamm for supporting documentation supporting the need for a service animal. White states to date, April 19, 2021, Ms. Hamm has failed to provide the documentation. (2) That Hamm lied to White in one of the conferences that she did not drive a truck down the side of U.S. Highway 52 with students riding in the back. Video evidence shows she did, according to White. (3) That Ms. Hamm has neglected her duties and/or failed to perform her duties in a satisfactory manner. That Mr. Glenn Malloy, the Supervisor over her department, met with Ms. Hamm in both March 2019 and September 2020 and identified areas of concern. NOTE:  Both of these dates were prior to Brandy White taking office as Superintendent of the Houston County Schools. (4) That between those dates and "to date as far as I know, you have still not addressed the areas of concern or issues he raised".

The letter written are from cue cards provided to Superintendents by the Alabama Department of Education. All of the letters from Superintendent White focus on the service dog and definitions of the service dogs. There two letters from Hamms doctor on March 19, 2021 and April 4, 2021 which are about the service animal. So I am a bit confused over the documentation from White's April 14, 2021 letter because he has actually three letters from Hamm's doctor. 

Hamm's medical records are covered by HIPA. While you are the Superintendant of Education to does allow you into her medical records. The doctor's letter is sufficient. 

Tonight on WDHN it seems they backed off the service animal and went after Ms. Hamm about Malloy's performance of Ms. Hamm's duties. By the way Malloy's son is an Assistant Principal that Malloy tried to bring in as a witness when he talked with Ms. Hamm. REALLY? Like son going to against daddy. REALLY, Glen Malloy apparently needs a write up for being stupid.

Like Malloy's observations were before Brandy White assuming the duties of Superintendent, Ms. Hamm filed a grievance against Glen Malloy before Brandy White took over as Superintendent. That grievance has yet to be addressed.

While I am not a lawyer your failure to act on the grievance adds to damages against you as Superintendant and the School Board members playing follow the leader. DAMAGES means money you would be required to pay if the right lawyer files a lawsuit.

Which means the money to educate students goes to pay for stupidity.

I have waited on addressing this issue. And there were two other Brandy White issues I am watching. You see the animal was backed off because of the federal laws which cover Americans With Disabilities Act. Because those actions would lead to a federal lawsuit against White, the Houston County School Board, reverse was sudden hit and Superintendent White and the School Board took the insubordination issue.

Insubordination is a issue that could later result in Ms. Hamm being terminated for any other witch hunt undertaken.

But White has placed himself and the School Board in jeopardy of a major lawsuit over the Americans With Disabilities Act. White has also placed himself, Malloy and the School System with possible legal action of a hostile work place over other action taken.

YOU ARE NOT A PUBLIC OFFICIAL BUT RATHER A PUBLIC SERVANT. Phone calls from those you serve are part of your job. Careful on your actions and Board Members, following the leader can result of your loosing what you have when someone files a successful lawsuit against you, professionally and in our official capacity. 

And for the record Ms. Hamm did not provide me with all of the documentation. Someone left it at my office and I can back up all I need to say. So careful!!!
