HOUSTON - HENRY GENEVA COUNTY AL. - JACKSON - HOLMES COUNTY FL.   This is a special alert and word of caution to all farmers, especially Houston County Alabama, Henry County Alabama, Geneva County Alabama, Jackson County Florida and Holmes County Alabama.

If someone from the OIG, the investigative arm of the United States Federal Government, or any local, state or federal law enforcement officer, DO NOT, DO NOT, DO NOT engage in a conversation without them without legal counsel. Competent legal counsel.

If you remember Martha Stewart. She was investigated for insider trading. She was not charged with that but with providing false statements to the FBI. With all of the electronic devices, the FBI policy was not to take a recorded statement. Two agents would talk to you and then prepare a report based on "their interpretation" of what you said.

Once I offended a FBI Agent because I said that I never talked with anyone who did not know how to use a tape recorder. They said it was against the policy of the bureau to record. And my response was it was against my policy to talk without it being recorded. I had zero issue in talking with them, but if I did then I want exactly what I said not their interpretation of what I said.

The crime is not in your refusing to talk without legal counsel. The issue is when you talk, and do not tell the truth, then you have committed a crime.

Under no circumstances, none, do you give a statement without competent legal representation.

WHAT AM I TALKING ABOUT?

If you have had any dealings with United State Department of Agriculture ( USDA ) the service center on Ross Clark Circle, the NAP Program, there are some things going on of which I have been alerted to, that do not pass the smell test on the part of the Government, Sonny Perdue and his staff in Washington D.C.

A local resident was charged with several federal crimes in the Middle District of the State of Alabama. 

 The charges stem from allegations that ( defendant ) was carrying out a crop insurance fraud scheme.  According to the indictment, in 2016, ( the defendant ) obtained crop insurance through a federal program, the Noninsured Crop Disaster Assistance Program (NAP).  NAP is a USDA program that provides financial assistance to producers of non-insurable crops when low yields, loss of inventory, or prevented planning occur due to a natural disaster.  Knowles insured a crop of summer squash that she was planning to grow on land in Houston County, Alabama.  Thereafter, ( the defendant ) filed a claim through the federal crop insurance program.  In that claim, ( the defendant )  falsely reported that a drought had caused ( the defendant ) to lose the majority of ( the defendant's ) squash crop.  ( The defendant ) also submitted forged receipts to establish that ( the defendant ) had spent money to purchase squash seed and fertilizer.  After filing the claim, ( the defendant ) fraudulently obtained $116,500.00 through NAP.  The indictment also states that, in ( the defendant's ) job at the USDA office, (the defendant ) was responsible for administering federal crop insurance programs in Houston County.

The defendant was represented by Dothan Attorney Matt Lamere. The defendant was found not guilty in the Middle District of Alabama in United States Federal Court. 

RSN is investigating some dirty tactics on the part of the USDA on people in the wiregrass area. As we are investigating RSN felt we needed to place the public on notice of some things we are learning.

(1) If you receive a letter, open the envelope with a knife or letter opener to maintain the integrity of the envelope that contains the postmark on when the postal service received the letter. 

It has been found the letters are dated 35 days before they are postmarked. You only have 30 days to respond to the letter, but allegations are they are holding the letters 35 days before mailing the letters. And they base your 30 days to appeal on the date of the letter.

Write on the letter the date and time received and keep the envelope.

(2) make sure you have all of your documentation on the NAP programs and any program you are involved in. It is being found documents in the file are not the same documents that are signed.

(3) record any and all conversations with government officials employed or was employed. TRUST NO ONE.

The USDA Program is attempting to withhold your money even though you have not been afforded the opportunity of your appeal rights. Which is not legal.

DO NOT DO NOT  DO NOT pretend you are exempt from these allegations or will not get 2016 or 2017 letters with accusations against you. And when you have a hearing the USDA is not having to prove you are guilty the farmers are having to prove they are innocent.

(4) Talk to a lawyer who knows what they are doing. Not just any lawyer is aware of or has knowledge of the common plan, scheme or design of USDA in this matter and the alleged illegal actions that USDA is committing and how the USDA is treating farmers.

DO NOT BURY YOUR HEAD IN THE SAND and pretend this is not happening.

Some have spoken to U.S. Representative Martha Roby, U.S. Senator Doug Jones. They were "monitoring" which is in essence they listened, walked out of the room and never thought of it again.

The actions of the USDA are going to financially destroy the American Farmer is their common plan, scheme, and design to deceive.

DO NOT - DO NOT  depend on the information the past management in the USDA Offices have given you. The office is located at 1849 Ross Clark Circle Dothan Alabama. The management, even suspended management, allegations are they are attempting to cover their own behinds and as long as they do not take the hit anyone is fair game to throw the investigation off them. But as I understand many people depended on what they were being told, which was false and inaccurate.

RSN is investigating information in this incident. Remember, when someone from the government comes and tells you they are from the government and are here to help you. RUN. That is a lie. 

As RSN gets into this we will update more. A lot of this I am having to learn about the farming and agriculture business. Be careful. I am not asking for anyone to not be honest. I am saying these people representing the USDA, if the information I am investigating turns out to be true, the government representative are not being honest.

And as usual your elected officials, Martha Roby and Doug Jones, have a severe case of amnesia and as normal, the elected officials forget who they serve.

The person charged in what was described above, was found NOT GUILTY. But the government has unlimited money to go after you while you have to spend everything you have and then some to fight the government.

USE CAUTION, DOCUMENT EVERYTHING, MAKE NO STATEMENTS, MAINTAIN THE ENVELOPES ANY NOTIFICATIONS COME IN AND MARK DATE RECEIVED, SPEAK ONLY WITH LEGAL COUNSEL WHO KNOWS THAT THEY ARE TALKING ABOUT, PAY ATTENTION TO THE DEADLINE DATES.

As we have investigated this issue, which is very difficult, and attempting to learn all of this. 

One thing I learned is the information given to farmers locally came from the handbook and directives from above.

These witchunt investigations are coming from way above the local offices of USDA. 

This article has a specific purpose - do not trust anyone, do not talk to anyone without recording it, retain documents, retain envelopes, and start documenting things as detals come to mind.

All of these programs are GREEK to me. I do not understand them and do not pretend to. 

But the guidelines given locally were in the book.
