During the early morning hours on October 11, 2020, Deputies with the Jackson County Sheriff’s Office were dispatched to a reported motor vehicle crash on Highway 231 just north of Wilmington Court with the driver still inside. Upon arrival of Deputies, the members of Jackson County Fire Rescue had already arrived and found a single occupant in the locked vehicle sitting on the side embankment of the roadway. The occupant was not responding to the rapid knocking on the window and shouting in an attempt to gain his attention. Due to the concern for the subject’s wellbeing, a window was busted to gain access to check on the subject.
After gaining access to the vehicle, a strong odor of an alcohol could be smelt emitting from the vehicle. The subject, identified as William Herndon, was awoken and medically cleared prior to interacting with law enforcement officers. While speaking with Herndon, a strong odor of an alcoholic beverage was smelled emitting from his breath. Herndon was asked to perform field sobriety exercises, to which he agreed to do so. Herndon failed to perform the exercises, requested of him, as instructed and was placed under arrest. Herndon was read Implied Consent and provided two lawful samples of his breath. The lawful samples were both double the legal limit of an impaired driver. Herndon was transported to the Jackson County Correctional Facility to await first appearance.
